03.01.2022 Members using Real Estate Australia Forms (reaforms online) are advised of recent upgrades to the commission clauses in Residential and Rural Agency Agreements. Legal advice cleared the way for lump sum and commissions being payable (probably not surprising) so the General Terms now clarify that agreements as to professional fees can be for commissions and or lump sums or both. Amendments also now allow for recovery of a commission where a contract is terminated by the vendor... and the deposit is released to the Vendor. The deposit is also charged with the Agents commission in that circumstance to assist with recovery. General Terms in the Agency Agreements are amended (clause 9.2) * clarifying any form of payments, lump sum fees and or commission can be agreed * clarifying that if a contract is terminated by the vendor (arising from purchaser default) then it is still a successful engagement allowing the Agent access to the deposit for commissions due * allowing payments even if no sale eventuates The Professional Fee area now has a drop in clause to use if members want to seek lump sums and commissions. A lump sum could for instance be credited if a commission was also payable. Users can edit the terms if they elect to use the new clauses. These provisions are designed to assist agents create packages and get recovery in tougher markets. Software users are also reminded that there is a Commission Uplift drop in clause in the Agency Agreement which members can use allowing commissions to be increased over sales thresholds for a bonus commission.
