17.01.2022 Commercial tenants will need to assess the financial effect on their business due to Corona Virus and social distancing measures before negotiating favourable dispensation from their landlords under a new industry code being developed. Prime Minister Scott Morrison has given an update following a meeting of National Cabinet, saying it was "close" to reaching an agreement for how affected commercial tenants and their landlords can get through the economic crisis caused by cor...onavirus. He said an industry code, to apply to commercial tenants who are eligible for the JobKeeper program, was being worked on but had not got to the point where the National Cabinet was prepared to sign off on it. Landlords are being encouraged to act in good faith when neginitiating with tenants and to seek assistance from their financiers. 07.01.2022 COVID 19 - Mandatory Code promotes good faith negotiations Have COVID 19 restrictions caused a significant impact on your business or premises? If so then it is critical you apply the National Cabinet’s Mandatory Code of Conduct SME Leasing Principles. The Mandatory Code allows commercial tenants to survive the COVID-19 period and operate sustainably in a reduced capacity or ‘hibernate’ completely until restrictions are scaled back. The application of the Code also allow...s commercial landlords to seek reduction in the payment of loan funds to financiers. 04.01.2022 I have stopped watching the news... I don't want to hear any more about tragic loss and family grief. Whether it's grief on a global scale with bombings, massacres or natural disasters or grief on a more personal level hearing about loss of life of someone too early or under tragic circumstances. I don't want to contemplate the possibility that similar tragedy or unexpected death of a loved one can happen and I don't want a feeling of hopelessness to impede into my day and w...hat I need to do. I don't feel like I can make a difference by listening to these stories of loss. However, what I can do and where I am trying to make a difference - is educate people about happens here in Australia when death happens. In particular, I am trying to assist people to protect their loved ones and their legacy when death does happen. Death being one of the few certainties in life. Ideally, you feel your life has purpose. That you are making a difference. In this flow of life, the choices that you make define you. Your friends or family or loved ones can benefit from your choices and your hard work beyond your death. You can choose to protect your legacy and their future in a very personal, beneficial and meaningful way: with an end of life plan. Why are people so busy creating a legacy and a portfolio of assets and income and yet reluctant to plan for these to continue benefitting their family beyond the end of their life? 02.01.2022 Legacy challenged?: Bob Hawke’s Will may be under threat of a Family Claim It is disappointing to hear when the legacy of a well-known and respected person becomes tarnished by the actions of a family member making a claim against an estate. As reported recently in the Sydney Morning Herald Bob Hawke’s estate may be challenged in the NSW courts by his daughter: https://www.smh.com.au//bob-hawke-s-daughter-to-sue-blanch It is reported that in his Will the former Prime Minis...ter left an equal amount of $750,000 to each of his children with his first wife (the late Hazel Hawke) and to his stepchildren of his second wife of 24 years Blanche D’Alpuget. The residue of his estate is reported to be left to his surviving spouse including the proceeds of sale of his $15 million former home. The Will looks like it may be challenged in the NSW Supreme Court as part of a family provision claim by Bob’s daughter, Rosslyn Dillon. This claim would likely be based on the assertion that the benefit gifted in the Will is not adequate to meet the needs of the recipient beneficiary. The same generation of the ‘blended’ family have been treated as equals, so on its face Bob appears to have acted fairly and reasonably in his Will by providing equal gifts for his children and step-children with Blanche. But what is fair to one person may not be fair to another. If the daughter can show that she was not adequately provided for in the Will or if the estate is not robustly defending the action, then Bob’s daughter may receive a payment either in settlement or by order of the Court. As these kind of claims are very expensive, the legal advisors for the estate and the claimant will likely benefit. The claim must be made within a set timeframe so we will have to wait and see what happens with the estate of Bob Hawke. Hopefully a claim will not proceed. Often clients say to us that they want a watertight Will that cannot be challenged. This can never be completely guaranteed. However, steps can be taken to reduce this risk. Estate planning requires in depth discussion of various issues, including consideration of which entities hold assets, the nature of the assets being held and the best way that the estate and assets can be structured with a view to tax minimisation, preserving generational wealth and other objectives the will maker wishes to prioritise.
