11.01.2022 Well this is an interesting article. This may unwind a lot of casual employment agreements. The wording Regular and Systematic (the old language) work patterns have been used for years in awards and used to determine the difference between casual and perm part time employees. It’s no different now. If a Billy Bob is a casual employee who works 6 hrs Monday to Friday every week and has done for more that 6 months, he is a Perm Part Time employee. That’s it. Can’t hide that fact. However if Billy works 6 hrs a day this week and 8 hrs per day for 2 days next week and then something different the next week that is not regular and systematic - it’s a workload that is fluctuating based on demand. Here is a snapshot of 1000 ads on Seek (Australia's largest Job board), taken today. - total of 77,835 ads - (pre C19 around 200,000) - ~ 50,300 full time - ~ 27,000 PT/Casual/Contract... - 6% ads from Agencies - 12% of ads from another Job Board owned by Seek The media said we have had a massive increase in jobs - we haven't. We are NO WHERE NEAR recovered

03.01.2022 Unfair dismissal claims soar - of course they do - I mean let’s face it, job keeper is paid in arrears and many organisations are going into massive debt just to fund the retention of people. However what is on the other side of C19? Is there a business still in place? So employers are really between a rock and a hard place. Speaking to a business owner recently and they have had 2 unfair dismissal cases lodged against them by people who were being performance managed pre C19. They said they will probably just close the business down as they were doing it tough before C19. There is no rule book here and the advice from the "experts" is pretty average as well.
