Maximum penalty for above offence is 30 penalty units or imprisonment for 18 months or both (in the case of a first offence) or 50 penalty units or imprisonment for 2 years or both (in the case of a second or subsequent offence). The Court is required to consider the best interests of the child as paramount. 6. The Court default position is that parents have equal parental responsibility for these decisions.
