22.01.2022 NAB former chief of staff sentenced to prison. This week a Rosemary Rogers a former chief of staff at the NAB was sentenced for her role in obtaining financial advantage by deception and being an agent corruptly receiving a benefit. The agreed facts stated that she fraudulently approved inflated invoices in return for financial benefits worth more than $5 million, between 2013 to 2017.... What is to dishonestly obtain financial advantage by deception in law? The offence is found in section192E of the NSW Crimes Act Under the heading of ‘Fraud’ stating: (1) A person who, by any deception, dishonestly-- (a) obtains property belonging to another, or (b) obtains any financial advantage or causes any financial disadvantage, is guilty of the offence of fraud. The offence has the following three elements: 1. The accused obtained a financial advantage for himself or herself or another or caused any financial disadvantage to another person (including a corporation); and 2. The accused used deceit (deception) as an operative cause to obtain the financial advantage or cause the financial disadvantage; and 3. Did so knowing it was dishonest. Dishonestly means being dishonest according to the standards of ordinary people and known by the accused to be dishonest according to the standards of ordinary people. 21.01.2022 It was another busy Court week here at Rep-Revive Criminal & Employment Lawyers. This week we were successful in obtaining a dismissal for our client charged with using a carriage service (Facebook messenger) to offend/harass/menace, which carries a maximum of 3 years imprisonment. Our client has a mental illness thus we were able to successfully submit to the Court he should be diverted from the criminal justice system into a treatment program with his psychologist. The Court agreed meaning that our client will now NOT face a criminal conviction or penalty and can instead focus on recovery.

One of the three was also charged with Assaulting Police in addition to the Affray charge. 08.01.2022 Today our principal solicitor Daniel Wilson succeeded in obtaining Appeals Bail for a client in the Sydney District Court Downing Centre. The client is in the process of appealing convictions handed down in the Local Court of Assault occasioning Actual Bodily Harm and Common Assault. The client is also appealing the severity of sentence meaning the application on foot is known as an "all grounds appeal". In first instance the Local Court Magistrate refused appeals bail. On 30... January 2020 the matter was for the first time in the District Court List. What became apparent in that list was there was some delay expected as the transcripts and exhibits were not on file. Sensing an avenue for bail might exist we immediately lodged a District Court bail application. That application was heard today. Detailed 14 page submissions were drafted and an Affidavit in support were tendered to the Court in support of the application. After a lengthy hearing we succeeded in having strict bail granted. To obtain this success we had to overcome the strict tests as set out in the Bails Act, including per Section 74 (demonstrating a change in circumstances (delay)), and Section 18, (demonstrating to the Court that a reasonably arguable prospect of success on appeal could be had (self defence & special circumstances)). Needless to say the client and his family are ecstatic with this result and can begin to now enjoy the freedoms lost in the Local Court. The all grounds appeal is now set down for 14 April 2020. On this date the District Court will determine if the Local Court convictions are in fact sound and/or if the sentence is too severe. See more

Plus Entre a dwelling to commit an indicitble offence, Common assault and a Stalk and intimidate offence. After repsentations to the DPP we were able to have 3 withdrawn bar the stalk and intimidate . 02.01.2022 This morning we attended Downing Centre Court for our client charged with possession and supply of a trafficable indictable quantity of GHB. During prior negotiations with police we were able to successfully represent the deficiencies in the prosecution case against our client. One specific deficiencies was the statue bar of the drug possession charge. Drug possession is a summary offence that means that police MUST commence proceedings in Court within 6 months of the allege...d offence. The prosecution commenced the proceedings 6 months and 1 day after the alleged offence. The alleged offence occurred we say before midnight meaning it was still the previous day, thus the delay in this case of the offence occurring just prior to midnight meant that the offence was statue barred by 1 day from proceeding. This resulted in our successful representation and the withdrawal of all proceeding against our client in Court today. Regardless, of the timing issue our client also had a warranted defence which was also represented to police of not knowing the clear liquid in a bottle found in the car he was driving was a drug. Possession and Supply requires knowledge and control before someone can be in possession and to that extend convicted of supply. 02.01.2022 Another great result today! Appeared at Downing Centre District Court on a sentence severity appeal. Client had received 2 full times custodial sentences, one of 12 months with a non-parole of 9 months AND another 4 month full time custodial sentence. Successfully appealed both sentences and was granted 2 non-custodial sentences; 9 months ICO and 9 months CSO respectively....
