No more pretending and nodding along ... we have a definition for you. A constructive dismissal occurs when an employee resigns due to the conduct of the employer. This may occur when an employer expressly asks the employee to resign or in circumstances where the employer’s conduct and treatment of the employee leaves him or her in the position where they consider themselves to have no choice but to resign. The employer’s conduct generally involves committing a serious breach of the employment contract or indicates that it no longer wishes to perform its obligations under the employment contract.
