16.01.2022 What you need to know about the super guarantee amnesty... The ATO will continue to conduct audits during the amnesty and if employers do not come forward, they will not be eligible for the benefits of the amnesty. Employers identified as not paying employees super guarantee payments will be required to pay: the super guarantee shortfall, nominal interest of 10%, administration fees of $20 per employee per quarter and a penalty (up to 200% of the super guarantee amount o...wed). You are able to claim deductions and not incur administration charges or penalties during the amnesty, but payments must be made before 11.59pm on 7 September 2020. If you are affected by COVID-19, you still must apply for the amnesty and declare unpaid super guarantee payments, however the ATO can work with you to establish a payment plan.
