16.01.2022 XERO USERS CRITICAL UPDATE: If you have recently processed an auto super batch through Xero and received a "failure" notice, we urge you to jump in and resubmit these ASAP. SuperChoice, Xero's superannuation clearing house, has confirmed that if these contributions are submitted by 2pm TODAY 24th June 2021 AEST, they should still reach the super fund providers by 30 June 2021. You will have been directly notified if you are affected and need to resubmit this information. If ...you have already successfully resubmitted these batches or processed this outside of Xero, no further action is required. For any cases that you have submitted in Xero regarding this issue, you will receive a case response with steps to complete this process. The cases will then close, however, if you do have further queries or concerns, all you need to do is respond to that case and it will reopen and assign to a payroll support team member who can assist you further. 09.01.2022 Treasury considers JobKeeper eligibility to include more businesses In announcing the $130 billion JobKeeper program on Monday, the Treasurer set out clear eligibility requirements including a 30 percent fall in revenue for businesses with turnover below $1 billion and 50 percent for those with turnover greater than $1 billion. However, following our concerns that many employers could miss out, given that some may not have been operational a year earlier or that their tur...nover may not have been representative of their usual turnover, the tax commissioner has now been given the discretion to make the final call. We have lobbied our respective professional bodies and local members to consider some of the unintended consequences. According to our information, the tax commissioner will be allowed to consider additional information that the business can provide to establish that they have been adversely affected by the impacts of the coronavirus, such as; Set out alternative tests that would establish eligibility in specific circumstances. Treasury explained that eligibility may be established as soon as a business ceases or significantly curtails its operations. Allow tolerance where employers, in good faith, estimate a greater than 30 percent (or 50 percent) fall in turnover but actually experience a slightly smaller fall. Assist businesses that have not operated for a full year, businesses that have employees but do not generate revenue, and businesses that engage employees via a related service entity. It is not clear yet how and when businesses will be able to seek the commissioner’s discretion and we will keep you informed on this, given the cash-flow pressure on businesses to retain or re-engage employees. We recognise that businesses are desperate for a lifeline, and given that the JobKeeper payments will not be paid until after 1 May 2020, it is our belief business owners need to engage with us immediately to consider cash-flow requirements and to identify any stimulus or ATO administrative concessions that may assist in keeping their business operating. 05.01.2022 Have you received a demanding or aggressive call from the ATO recently? Call scams have been doing the rounds again We’ve had a couple of clients call us stating the ATO has called threatening they will be arrested or commencing legal action And they are not alone! There is usually a large spike in spam calls, emails and letters during tax time, with this year’s round appearing to be more aggressive and threatening than we have seen before. Scammers are now sending unsol...icited pre-recorded messages (robo-calls) to people’s phone. These are delivered when you answer or may be left on your voice mail. They often ask people to return the calls as the act of responding gives the scammers increased certainty of speaking to someone who believed the message. Another relatively recent scam involves the use of messaging platform WhatsApp, where scammers impersonate the ATO and ask call recipients to send a photo of their driver’s license, passport or other identity credentials via WhatsApp. To help you spot a scam, remember: ATO will NEVER use aggressive behavior or threaten immediate arrest, jail or deportation. ATO will NEVER request payment of a debt via iTunes or Google Play cards, pre-paid Visa cards, cryptocurrency, direct credit to a personal bank account (Check the BSB is the Reserve Bank of Australia, otherwise, it’s a scam) or offshore wire transfer. ATO will NEVER send an email or SMS requesting you click on a hyperlink to log on to government services Calls originating from ATO will NOT show a number on caller ID, scammers use technology to project legitimate numbers on caller ID (which could also include legitimate ATO numbers) so do not call back any numbers on caller ID or your call log. ATO will NEVER request you pay a fee via Credit Card in order to receive a refund. ATO may use SMS or email to contact you, but they will NEVER ask you to provide personal identifying information via these methods in order to receive a refund. ATO are on Facebook, Twitter, and LinkedIn, but they will never use these social media platforms to ask you for payment or personal identifiable information. If you’re ever unsure if an ATO interaction is genuine, DON’T REPLY to it. Instead, call the ATO on 1800 008 540 or your tax agent.
