Please note that the below information is in relation to the Building and Construction General On-Site Award (MA000020). You may view the full Award here, and the inclement weather clause here. Please let me know if this is the incorrect Award. Inclement Weather - Rain According to Clause 23.2 of the Award, inclement weather means the existence of rain or abnormal climatic conditions (whether hail, extreme cold ,high wind, severe dust storm, extreme high temperature or the like or any combination of these conditions) where it is not reasonable or it is unsafe for employees to continue working in those conditions. This confirms that inclement weather does indeed include rain. Casual Employees Allowance Under the Award, a casual employee is entitled to all of the applicable rates and conditions of employment prescribed by this award except annual leave, paid personal/carer’s leave, paid community service leave, notice of termination and redundancy benefits. The relevant provisions does not exclude casuals from the benefits of the inclement weather clause of the Award. Casual employees are therefore entitled to inclement weather clause. There is no specific time frame outlined within the award for how many hours they would be paid. However, if the shift is cancelled due to inclement weather, and they were rostered on for 6 hours for example, then payments for the ordinary hours are to be made based on what they would have worked (i.e. 6 hours). The maximum payments are provided in clause 23.8 (a) of the Building and Construction General On-site Award 2010. The term ‘required to attend work’ is not defined in the award. As per the reading of clause 14.4, each time a casual employee works, they have to be given at least 4 hours of work (or paid for 4 hours). This implies that if a casual employee is required for work, but does not come into work due to inclement weather, the employee may be entitled to a minimum 4 hours of pay.
