12.01.2022 *Why may bail be refused?* Considerations such as prior criminal history, the seriousness of the charge, the risk of reoffending, previous breaches of bail or if there is a genuine chance that you will not appear at your next court appearance, will all weigh into whether or not bail will be granted. In some cases, you will have to "show cause". This means, that as the defendant you will have to show that your current imprisonment is unjustified, and that you should be granted... bail. Show cause is usually applicable where you have: A failure to appear offence recorded Breached bail Committed a serious or violent offence Committed domestic violence offence Committed an offence with at least a maximum penalty of seven years Examples of conditions that may make your imprisonment unjustified include: Lack of previous criminal history The period of time in which you will be in pre-sentence custody will be longer than the likely sentence that will be imposed You are not an unacceptable risk Relevant considerations in relation to your character, antecedents, employment, or background As a leading criminal defence law firm, Russo Lawyers has the experience and dedication to ensure you know your rights and are adequately represented, whether you've received bail before or not, please contact us today for a no obligation initial consult. 3238 1888

05.01.2022 3 reasons for adjourning a Magistrates Court hearing Adjourning a hearing is an option that should only be used if the applicant will benefit from the court date being moved. A holiday or social event is not a good reason to postpone your adjournment reason needs to be sufficiently justified. Causes could include: Requesting more time for reviewing the materials presented in the initial hearing.... The defendant's legal counsel requiring additional preparation. This could include discussing defence options with the client or negotiating with the plaintiff for a suitable settlement. Personal reasons, if they are suitably extenuating. Medical grounds, such as sickness or an appointment that can't be moved, are usually accepted by the court. Other reasons, such as compassionate grounds or personal bereavement, are often suitable for adjourning your court date. See more

03.01.2022 **Choking, Strangulation and Suffocation in a Domestic Setting** As of May 5, 2016, it is an offence in Queensland to choke, strangle or suffocate a person in a domestic setting. This comes at the recommendation of the Special Taskforce on Domestic and Family Violence in Queensland. The purpose of such an offence is to prevent what has been referred to as the ‘last warning shot’ in domestically violent relationships and aims to reduce the number of domestic homicides. Under s... 315A of the Queensland Criminal Code, the Prosecution must prove, beyond reasonable doubt that the choking, suffocation or strangulation was done without excuse, and without the consent of the complainant. To be considered an offence under s315A, the complainant and the accused must be in an intimate personal relationship, family relationship or an informal care relationship considered to be ‘domestic’. The aggrieved may be a romantic partner, relative or child of the defendant. Choking is yet to be defined in legislation, however in case law it has been described as an act that hinders or restricts breathing. It does not need to stop the breathing completely. As assault is not an element of the offence, it need not be proven that any injury or death was caused or intended. As a leading criminal defence law firm, Russo Lawyers has the experience and dedication to ensure you know your rights and are adequately represented, please contact us today for an initial consult. 3238 1888 - 24/7 . . . #russolawyers #criminallawyersbrisbane #brisbanecriminallawyers #law #court #brisbane #lawyers
