25.01.2022 With Christmas Day, Boxing Day, New Year’s and Australia Day (January 27th as AusDay falls on a weekend) all coming closer it is important you’re on top of public holiday pay standards for your staff. Here is some information from FairWork: Public holidays form part of the National Employment Standards (NES). The NES apply to all employees covered by the national workplace relations system, regardless of any award, agreement or contract.... The NES provide an entitlement for employees to be absent from work on a day or part-day that is a public holiday. The NES protect an employee’s workplace right to reasonably refuse to work on a public holiday, and will guarantee payment where an employee is absent from work because of a public holiday. Employees are protected from adverse action for having, using, or seeking to use their workplace right to reasonably refuse to work on a public holiday. 24.01.2022 In August, our director, Caroline spoke at the RACS 2019 Conference held at College Of Surgeons Gardens on Spring Street. RWS were once again invited by RACS to present to younger fellows on the preparation for practice conference. Caroline has been a regular speaker for RACS in Victoria, Queensland and South Australia. 24.01.2022 Our recruitment expert, Michelle Knightley discusses profiling in recruitment. There are many studies that feel this is true, particularly when marrying general mental ability, relevant work experience and personality profiling. There are many available options to use this tool. One option is to profile your existing team and determining what is a good personality fit for a new starter. Another option is to profile your top 3 or 4 candidates, to get further information to... assist in making the right selection. We all agree that selecting, recruiting and training costs companies/practices a lot of money. The more we can do to make this process a smooth and successful one and for the new starter to fit quickly and easily into the team initially and to be a valuable long-time employee, the better. Rather than relying on a gut instinct! At RWS we recommend all your practice staff undergo the profiling process (including Principal Doctors), don’t worry this doesn’t take much time. This process allows us at RWS to understand more about you and your staff, work and personality types. This then assists us in selecting a suitable candidate who will not only work harmoniously with your team but will minimise clashes, then everyone is a winner!

23.01.2022 Our resident architect, Jack Tu wrote on converting a residential property to medical rooms: Architecture and Design When considering setting up your practice, a great strategy is to convert an existing residential property into medical rooms. The more intimate environment and familiar setting can play a big role in retaining patients. ... Some key things to consider: Permits and Parking: There will typically be a planning permit requirement for a ‘change of use’ from a residential property to a medical practice. An important factor that council looks for is how much on-site car parking is available. In most cases a reduction in car parking can be applied for. We regularly work with our planning consultant and traffic consultant to assist in these type of planning applications. Accessibility and Dispensations: A residential house will usually need to have adjustments made to allow for the more onerous disabled access requirements of a medical practice. Prior to purchase of the property, we can make a site visit to do a preliminary review. Typically, we also arrange for our builder to attend to provide comments on building condition and to identify potential construction issues. In cases where we feel that dispensations may be required, we will also work with our building surveyor to review. Latent Conditions and Layout: Particularly with older properties there can be unforeseen discoveries during renovation which can limit potential layout options. As soon as possible after the property purchase and settlement, we recommend having our builder arrange for more thorough investigations as required. In concert with our structural engineer, our builder will make strategic penetrations to the walls, floors and ceilings to reveal the structure and building cavities. This will help identify potential limitations early in the design process and help keep the costs of changes during renovation to a minimum. 18.01.2022 Peter Chaplin our accountant & practice management specialist gives us an HR Update: 3% Pay rise for employees 1st July 2019 The government approved a 3% pay rise to the minimum wage rates and those employees covered by a modern award effective from the 1st July 2019. This would include any employees working at a medical practice. ... Whether or not you need to pass on the 3% increase, will depend on your employees current rate of pay. We recommend that all employers review their employees current rate of pay and compare the employees current pay rate to the new award rates, to confirm that they are paying at or above the award. Single Touch Payroll (STP) From the 1st July 2019, it is compulsory for all small businesses (those with less than 19 employees) to send pay, tax and superannuation information from your payroll software, as you run your payroll. Micro employers (1 4 employees) still need to report via STP, but this can be done via a tax agent or registered BAS agent on a quarterly basis, up until 30 June 2021. 17.01.2022 Making a Positive Impression on Patients 3 tips for your practice A major contributor to practice prosperity is the first impression patients form. What we know from years in this business is that patients report back to their GPs about you! Ensure the experience is a positive one. Make Each Patient Feel Special When a patient first visits your rooms, or enquires by phone, make a concerted effort to understand their needs and what you can provide to meet those needs. They s...hould do most of the talking to begin with, before you attempt to provide a solution. An ongoing relationship grows from a positive first impression, followed by a demonstration of your compassion and care. Seriously consider formal training for your staff in this area. Don’t leave first impressions to chance. Aim to Exceed Patient Expectations Think of ways at your practice to exceed expectations of patients. Staff might be able to make the elderly a cup of tea for example. As a minimum each patient should be chatted to with pleasantries that are relevant to them. For example, Good morning Mr Smith, how has your day been so far? is welcoming and shows you care. Everyone wants to feel valued. Address sources of dissatisfaction If a patient is not happy find out why. You don’t want patients returning to GPs to voice their discontent without you even realising they were unhappy. Set the expectation for staff to ask patients how they found the service. A feedback box also works well. This will allow you to rectify any issues (hopefully before they return to their GP) and will provide fantastic marketing data for you as well. 17.01.2022 Are you aware of the recent changes to casual staff awards? There have been some recent changes to the Health Professionals and Support Service Award that affect casual staff members. In October 2018, the Health Professionals and Support Service Award was amended to include a model casual conversion clause. As many practices have casual staff members in their employ, we wanted to share with you the key points of these changes that you need to be aware of.... What is the change? Essentially, regular casuals can request to convert to either part-time or full-time status. Approval will be based on the business needs and requests need to be made in writing. The requests can be denied provided appropriate consultation takes place and there are fair and reasonable grounds for the refusal. Who does this effect? A regular casual is one that works a regular pattern of hours on an ongoing basis. In particular where it can be identified that the patterns of work, without significant adjustment, could be considered as a full-time or part-time hours employee under the provision of the award. An example of this might be a medical receptionist that for the past 15 months has worked five hours per day every Monday, Wednesday and Friday and is on a casual contract. What do you need to do? An email should be sent to all casual staff at your practice to let them know of their right to casual conversion and providing the relevant casual conversion clause. Ensure you make updates to your employment contracts to cover all future casual contracts. Treat every conversion request in line with the requirements of the clause. Shift work rates There were also changes to the rates of pay for those staff who work on Saturday, Sunday. The changes apply from the first pay period on or after 9th January 2019. Need Help? 15.01.2022 Exciting News..... PodMD is now live! PodMD creates medical podcasts by doctors for doctors. It is a joint initiative between Dr Sean Mackay, (Melbourne-based upper GI surgeon) and Caroline Chaplin, (Director of RWS). Remaining clinically up-to-date is an ongoing challenge. Doctors needed a way to reliably and conveniently stay informed. Attending conferences can be expensive and topics are often narrowly focused. Reading medical journals is time consuming and will tend to be... very in-depth but may lack the broader context that comes from clinical experience. Podcasts seemed the obvious solution. Updates are punchy and brief, and can be listened to within the clinic setting, whilst exercising or in transit. PodMD creation began in late 2017, committed to the vision of making knowledge sharing easier, and more collegiate for doctors. Since then, we have been building a library of podcasts across many disciplines. Every month more are created, from doctors across Australia. Let’s face it, it would probably save you money right? Wrong! At RWS we strongly advise you to use a professional in this instance. We advise this, to ultimately protect your... Practice. Small changes in a contract can have huge impacts on you legally and financially. We have seen this happen many many times. Awards and Fairwork Australia’s regulations change regularly. Are you confident you can keep up with the many nuances of the law! Remember the famous phrase in law Ignorance is no Excuse! Do it right the first time, don’t get caught! To further protect your practice, ensure that all Employment Contracts and any other confidential papers are put in a locked electronic or paper file. 14.01.2022 A number of recent decisions of the courts and FairWork Commission may require you to review your use of casual employees. From the 1st of October the Health Professionals and Support Services Award 2010 now includes clause 10.5 Right to request casual conversion. Essentially this clause states: ... Regular casual employees can request that their employment is converted to full-time or part time. A regular casual is a casual that has worked a pattern of hours in an ongoing basis over the past 12 months. For example, if your casual works Tuesdays and Thursdays 9am to 1pm, and has done for over 12 months. The conversion will take effect from the start of the next pay cycle. Long service obligations to the casual will not be affected. RWS recommend writing a new contract to reflect the change of status and appropriate comment with regards to the rate of pay and other entitlements. 06.01.2022 Why do most medical fit outs require a Building Permit? It is a common perception that medical practice fit outs don't require a building permit. A 'Building Permit' suggests something substantial so naturally we think that a building permit is something that would only be required when the works involve changes to the building structure. However, this is not the case! Even something as little as changing the floor finish, ceiling finish or installing lightweight partitioning... (even if the partitioning is not full height) triggers a requirement for a building permit. The reason for this is due to the fire safety requirements from the national construction code. For example The material that is chosen for a floor or ceiling finish needs to be compliant with Australian standards. The path of travel to a fire exit is impacted by any fixed partitions, even if not full height. The building surveyor or certifier is required to review and approve that these requirements are met. When RWS takes on a new project, we typically recommend getting our building surveyor on board to do a preliminary regulatory assessment. We work closely with the building surveyor to identify and resolve potential issues, and to confirm whether a permit is required for that specific medical practice fit out. A little additional cost at the beginning of the project can end up saving our doctors a lot of money as well as avoiding unnecessary angst later on. Jack Tu Architect - RWS
