03.01.2022 Another day, Another Amazing Clients Feedback! Child's Best Interest - What does it mean in Family Law Best interests are being met when:... Children are protected from physical harm, abuse, neglect or violence; Children receive proper parenting to help them reach their full potential - physically emotionally and academically; Parent's fulfill their responsibilities for the care, welfare and development of their children; Children have the benefit of meaningful relationships with both parents. Yesterday, was a grueling 7 hours in the Federal Circuit Courts - Sydney. The matter is complex and cannot be summarized. However, in crux, the Mother has always harbored and promoted a meaningful relationship with the Father. However, the Father has a history of non-compliance, intimidating/controlling behavior and abuse towards the Children, the Mother and the Supervision Agencies. He has wrongly burdened the Courts with unnecessary Application in a Case and put his case forward in the COVID19 listing. To make things worse, the Independent Children Lawyer (ICL) was not seeing through the Father's lies, history of abuse and more importantly had total disregard to the risks the Children would have had on an unsupervised time with the Father at his place of residence. My work was doubled, when I had to prove the obvious risks, whereby the ICL was adamant that there are no risks. Judgement was not only in favor of my client, but her children and their best interests - THIS IS THE WHOLE POINT IN A FAMILY LAW PROCEEDING! . Interestingly, the Judge put little weight to the ICL's recommendations. Outstanding result to see the amazing Judge Neville. Her Honour, albeit being strict - gave an outstanding judgment and protected the Children from the risks "denied"/"unseen" by the other parties. #Justice #Served #Not #Denied.
