22.01.2022 Australia’s first industrial manslaughter conviction - $3mil fine plus jail for Directors On 11 June 2020, a Qld business (Brisbane Auto Recycling Pty Ltd) was convicted and fined $3 million and the two Directors were each sentenced to 10 months’ imprisonment after pleading guilty to causing the death of a worker and being negligent about causing the death. This is the largest workplace health and safety fine ever imposed in Australia and the first under new industrial mans...laughter legislation. Industrial manslaughter (called workplace manslaughter in Victoria) is now law in most states and territories in Australia. In this case, a person was hit and killed by a forklift driven by an unlicensed driver. The judge said that the Directors knew of the risk to the safety of their workers but consciously disregarded that risk.
