25.01.2022 The Department of Social Services is inviting people to have their say about the meaning, location and design of the National Memorial for Victims and Survivors of Institutional Child Sexual Abuse. You may recall that this was a recommendation of the Royal Commission. The survey is open until this coming Monday (30 November 2020, 11.59pm AEDT) and can be completed anonymously. Anyone can join the survey, including survivors, their families, advocacy and support groups, and other interested community members. The survey can be completed online at https://engage.dss.gov.au/national-memorial-for-victims-// and takes under 30 minutes to do. The survey can also be printed off the website (PDF or Word) and completed by hand.

New changes to the Judicial Proceedings Reports Act now make this impossible in VIC - otherwise, survivors risk spending months in jail or copping heavy fines. The laws apply to sexual assault survivors whose abusers have been found guilty of their crimes, or whose cases are still before the courts. 12.01.2022 Dr Cathy Kezelman AM, President of the Blue Knot Foundation: The outcome of George Pells appeal is poised to have a profound impact on survivors around the cou...ntry. His conviction represented belief in the victim and the power of the legal system to dispense justice regardless of who the alleged perpetrators of sexual abuse are. In this case the victim was believed and Pell, a powerful member of the Catholic Church hierarchy was convicted. Each time this case or any other high-profile case is re-examined legally rightly or wrongly, to victims it feels as though the credibility of survivors is on trial. The release of George Pell on appeal would be very difficult for many survivors. This is because for some it will mean that regardless of the courage and determination of victims, legal process can intervene and lead to different outcomes. Speaking out, being heard and being believed are bottom line for so many victims. For many the legal process has been too daunting to consider. For such a high-profile case to undergo so many twists and turns, all of which are of course part of due process, speaking out in the legal system can seem even more unachievable.

Male survivors of childhood sexual abuse face some unique impacts. Some of these arise from social expectations about men, and cliches around what constitutes "masculine" behaviour. 09.01.2022 SAMSN welcomes new Tasmanian legislation which gives courts the power to set aside a previous settlement if it is satisfied it is in the interests of justice to do so. The Justice Legislation Amendment (Organisational Liability for Child Abuse) Act 2019, which came into effect last week, will allow abuse survivors who previously received unfair settlements to seek further compensation. Survivors will also now be able to sue unincorporated organisations. The full media release can be read here:

07.01.2022 We are hearing strong opinions from lawyers, journalists, commentators and many others after the High Courts decision to acquit George Pell this week. We have now heard from the victim in the case via his lawyer. Despite everything, he is acting with such dignity and thinking about his fellow survivors. A jury unanimously found Pell guilty. After hearing the evidence, all 12 jury members determined Pell was guilty beyond reasonable doubt. It just wasnt enough to stick in... this high-profile case. Substantial findings from the Royal Commission into Institutional Responses to Child Sexual Abuse regarding George Pell had to be redacted in order not to prejudice the trial. These documents will be released soon. As a survivor of child sexual abuse who went through two criminal trials 10 years ago against two of my three perpetrators, I know the pain of one win and one loss. I know what it feels like when the jury gets it wrong. I cant describe the deep frustration and anger I felt when I realised that the Director of Public Prosecutions is unable to challenge an acquittal and there are no legal avenues for survivors to take. As the co-founder and CEO of Survivors & Mates Support Network (SAMSN), my heart goes out to Witness J and to our growing survivor community. It is not easy to deal with the impacts of CSA as an adult. Many survivors struggle with the feeling that they are responsible to stop offending behaviour. To them I say, it is not your responsibility. Nor is it a path easily trod. Despite having experienced this himself, the victim in the Pell case has asked everyone who can, to still report. This can be a difficult decision but there is support available to you to do whatever you choose. To the survivor in the Pell case, your truth is your truth no one can take that away from you. The people who love and support you and have stood beside you in this protracted legal process know your truth. They have witnessed your strength and determination to seek justice. They now know what stands in the way of justice for survivors of CSA, who must navigate a legal framework that is far from a level playing field. Among our community of survivors who are finding their voices, you are believed and respected for what you have achieved. We wish you and your family good health and healing. Id like to remind survivors and our valued supporters at this very confronting and challenging time that we are here for you. You are not alone. 01.01.2022 The High Court in Canberra will this week hear Cardinal George Pells appeal against his convictions for abusing two choirboys while he was Archbishop of Melbou...rne. The case will be heard tomorrow and Thursday although a decision may not be handed down this week. The proceedings will not be livestreamed. This represents Cardinal Pells final chance to have his convictions overturned after his first appeal was dismissed in September last year.
