25.01.2022 I thought I would share some facts from an employment law - dealing with COVID-19- seminar I attended this morning. With the Federal and State governments making daily changes in the face of the corona virus, I hope this assists some businesses. Firstly, know your business. Sounds simple, but it’s important for several reasons. If it is a non essential business and you have to go into lock down do you have a plan and transition for your staff. Or if you are able to stay ...open, can your staff continue to work safely. Either way what safety measures need to be implemented and what are the options? Firstly, if staff are unable to work safely ask if they are able to carry out duties at home, remember if staff work from home OH&S laws continue to apply, as well be sure that any award or enterprise agreement is being complied with. Secondly, is recreational leave available, annual leave or long service leave. There are laws governing when and how an employer can direct an employee to take leave, so be sure you check with their employment contract or the Fair Work Act. A third option may be to stand down employees for a specific period. Stand downs can be tricky so I suggest you do not proceed with this action without specific advice. These are difficult days however the most important thing to remember at this time is to keep the wheels of communication going, confusion and the unknown are part of our daily lives, therefore communicating with staff is imperative. Keep the language simple, and stick to what you know, no guess work. We all want to get back to work, and embrace certainty into our lives, but in the meantime, let’s all work together and get through these times the best we possibly can.
