16.01.2022 FEDERAL COURT WIN Great victory today at the Federal Court in the migration related appeal matter where it is very difficult to overturn migration decisions. Judgement handed in our favour where the judge found two grounds of jurisdictional error in our clients favour. Excellent effort by Counsel instructed in the matter. Thank you Counsel T. Baw. I am extremely happy that the Federal Circuit Court decision got overturned today. My clients are also super ecstatic. Judgement to be posted later. With Counsel and client in pix.

14.01.2022 Great result for our firm and client in the Parramatta District Court this morning. Our Severity Appeal against a 6 month driving suspension and monetary fine was successful. Client got a Section 10, meaning no conviction recorded. Client has got his drivers licence back. Happy client and happy legal team.

13.01.2022 Skilled Migration Points Increase It is now going to be much harder for students to qualify for Permanent Residence under the Skilled Migration Program. From 1 July 2018, applicants wishing to apply for the following visa subclasses will be required to obtain a pass mark of 65 to be eligible to receive an invitation to apply: Skilled-Independent (Permanent) (Class SI) Subclass189; Skilled-Nominated (Permanent) (Class SN) ... Subclass 190; and Skilled-Regional Sponsored (Provisional) (Class SP) Subclass 489 This is an increase of five points. The Department of Home Affairs said the new pass mark reflects the high level of interest in skilled migration to Australia and the high calibre of prospective applicants who express their interest in the General Skilled Migration program. Under the transitional arrangements, the pool and pass mark from the previous instrument is preserved for all visa applications for the above visas made before, on or after 1 July 2018 in response to an invitation given by the Minister before 1 July 2018. Defending a client against the might of the Australian Taxation Office (ATO). Early days yet. Confident we can reach terms of settlement. Amazing and interesting week so far. These new visas will promote regional migration and replace two existing subclasses: The New Visas... Skilled Work Regional (Provisional) visa (subclass 491) Skilled Regional (Provisional) visa (subclass 489) - first provisional stream Replaces Skilled Employer Sponsored Regional (Provisional) visa (subclass 494) Regional Sponsored Migration Scheme visa (subclass 187) - Direct Entry stream Benefits of new visas Priority processing of regional applications Incentives for migrants to stay in regional areas longer term as they build ties through workforce and community participation Can apply for permanent residence without a second nomination stage, if eligible, through the subclass 191 visa (commences 16 November 2022) Lower cost to employers with only one SAF levy stage for the subclass 494 nomination (compared to the two stages for the current subclass 482 to ENS subclass 186 permanent resident pathway) More points available to subclass 491 visa applicants Broader range of occupations available than non-regional pathways Expanded and consistent classification of regional areas The minimum taxable income for the subclass 494 and 191 visa will be set at the Temporary Skilled Migration Income Threshold (TSMIT) unless concessions are agreed (such as in relation to a DAMA). TSMIT is currently $53,900. We will provide more information about the new skilled regional visas shortly.

02.01.2022 Family Violence and Cross-examination of Parties Scheme Amendments to the Family Law Act 1975 (Cth) have been made that provide protection to victims of family violence who are cross-examined as part of family law proceedings. From 10 September 2019, personal cross-examination will be banned in family law proceedings in certain circumstances where allegations of family violence have been raised. Personal cross-examination is where a party asks questions of another party or w...itness directly, rather than having the questions asked by a lawyer. Under the scheme, cross-examination will now be conducted by legal representatives. The scheme is funded by the Commonwealth Government, who will provide $7m, over three years, to legal aid commissions to provide legal representation to parties subject to the ban. This will remove the fear of being directly cross-examined by their perpetrator as a factor in a womans decision whether to settle a matter, and encourage women who have experienced family violence to pursue their legal entitlements. The provision of legal assistance will also support the expeditious resolution of family law matters, assisting women to recover from abusive relationships and obtain economic security for themselves and their children sooner. 01.01.2022 This is the really sad state of affairs when it comes to Partner visa applications. Our firm has a few applications that has been in the Department of Home Affairs pending list for well over 20 months. In the event the application is refused, then the applicant has to go through the ordeal of an administrative appeal process. We are hopeful that at the time of visa grant, the decision will be made on both the temporary and permanent visa at the same time. One can only hope.
