15.01.2022 Currently, a Seller must provide a valid clearance certificate to the Buyer at or before settlement for real property disposals with a market value of $750,000 or more, otherwise the Buyer is required to withhold 12.5% of the purchase price at settlement and remit the payment to the Australian Tax Office (ATO). Here are some timely tips on obtaining foreign resident capital gains withholding clearance certificates: 1. Lodge applications for clearance certificates as early as ...possible it is recommended that applications are lodged when a property goes up for sale, rather than waiting for a contract to be signed. We note certificates are current for 12 months. 2. If you wait for a contract to be signed before getting the certificate, remember to include the additional 28 days processing to get the certificate in time for settlement. There are no guarantees applications for certificates will be processed before that timeframe. 3. Applications for non-individuals, such as companies, take longer to process, which means the ATO may need the full 28-day processing period. 11.01.2022 On 5 October 2020, the Treasurer and the Minister for Housing and Assistant Treasurer announced the removal of Capital Gains Tax (CGT) from granny flat arrangements. Under the measure, CGT will not apply to the creation, variation or termination of a formal written granny flat arrangement providing accommodation for older Australians or people with disabilities, their announcement said. 06.01.2022 Our clients often ask when Buying property: What is the difference between Joint Tenants and Tenants in Common? When there is more than one Buyer of real property the property must be held as Joint Tenants and/or Tenants in Common.... JOINT TENANTS Usually they own the property equally. Following the death of a Joint Tenant the share passes to the other Joint Tenant/s (in equal shares if more than one) automatically without reference to any intention of the deceased person. The most common use of holding as Joint Tenants is a husband and wife situation where upon the death of the husband or wife their interest automatically passes to the surviving party. TENANTS IN COMMON Usually they own specific shares of the property (equal or unequal) which are recorded on the Title. An important advantage of a Tenants in Common is that the shares are protected in the proportions designated. If a Tenant in Common dies their share of the property passes in accordance the instructions of their Will.
