23.01.2022 Nala’s Matter: Holding negligent puppy farmers accountable using the consumer law In July 2018, volunteer lawyers from the Animal Law Institute (ALI) launched legal action against Nala’s breeders to hold them accountable for the cruel consequences of their negligent breeding. Three months later, the Victorian Civil and Administrative Tribunal (VCAT) handed down its judgment in Nala’s favour! The lawyers were successful in creating a legal precedent to discourage negligent b...reeding and puppy farming in the future. 22.01.2022 In March 2012, RSPCA NSW announced that it would be rolling out a program, in conjunction with the Pet Industry Association of Australia, whereby the PIAA could brand their association pet shops as ‘RSPCA approved’ and in return, the RSPCA would take any dogs who failed to stay in their new homes (for a fee). Then an advertising campaign (sponsored by the state government at NSW taxpayers' expense, at a cost some estimated at around $200,000) was used to direct funds directly... into RSPCA NSW coffers. If you signed up to #ClosePuppyFactories you would likely have been targeted as a regular donor #ClosePuppyFactories was the biggest prank ever pulled on the pet loving public. It directed vital funds from projects that are working to close puppy factories in earnest. 21.01.2022 California is on the verge of closing loopholes that allowed breeders to violate its ban on the retail sale of commercially-bred dogs, cats and rabbits in pet stores by masquerading as rescue groups. Last year, California became the first state in the country to ban the pet store sale of commercially bred dogs, cats, and rabbits. If pet stores wanted to have animals available, they were required to work with rescue groups or municipal shelters to adopt out animals. The law h...as been fairly successful, with Nebraska Department of Agriculture records showing that half of the state’s commercial dog and cat breeders have left the business, with an admission that Midwest breeders were hurt by a California law that banned pet stores from selling commercially bred puppies, kittens and rabbits. But it hasn’t been completely successful. Iowa’s Attorney General, for example, said his state was home to a national ‘puppy laundering’ ring that sells puppy-mill dogs under the ruse of adopting rescue animals. According to the lawsuit he filed, puppy mills and unscrupulous pet stores are conspiring to violate the ban on selling commercially bred animals in pet stores in California and elsewhere. The puppy mill brokers form non-profit organizations and pretend to be rescue groups. The source of the puppies doesn’t change, the amount charged for the puppies doesn’t change, the profit to be made doesn’t change, and most important of all, the neglect and abuse of the mothers in those mills doesn’t change. The only thing that changes is the terminology: they call it an adoption, instead of a sale. Now, California is poised to close loopholes that allow this to continue. AB 2152 which has passed both the Senate and the Assembly and is awaiting the Governor’s signature requires all animals available at pet stores to be sterilized, prohibits total adoption feeds from exceeding $500, and prohibits the pet store from receiving any fees or other compensation in connection with the display of dogs, cats, or rabbits. In 2016, one of our team was called to a NSW property where a shallow grave had been unearthed and contained a number of dead purebred dogs who had been shot. These registered purebred dogs had been used for breeding. A report was immediately made to RSPCA NSW who some days later attended the property. 16.01.2022 A South Australian woman has been convicted after more than 100 cats were found in appalling conditions at a breeding facility. In Elizabeth Magistrates Court on Thursday, the 66-year-old breeder was found guilty of ill treatment of an animal and failure to comply with breeding standards. 13.01.2022 Online trading platforms including Gumtree and Facebook have never taken a responsible approach with the selling, buying or advertising of any animals including companion animals. Now Gumtree has introduced advertising fees (rescue organisations are exempt), likely to boost their own revenue, rather than adopt a responsible approach to the selling of companion animals. Applying a fee to generate revenue for Gumtree makes no difference for the animals. One owner, who has a facility near the region, has applied for approval to build a small-scale commercial animal boarding and training facility (dog breeding facility), which will include four dog yards, two puppy nurseries, a quarantine shed, a dog kitchen and a building for residential and business use.
