25.01.2022 Almost all of us have some form or another of 'digital assets.' But have you thought about what will happen to your digital assets on your death? It may seem trivial to you or perhaps you have the mindset of "she'll be right" and everything will be 'sorted' when you die. BUT....it may not. Our lives are becoming more and more entangled digitally. We all need to think about dealing with those digital assets in our Wills.

22.01.2022 An article with some vital information for anyone that has a SMSF! Superannuation is potentially your second largest 'asset' after your house. It is essential to make sure you have 'ticked all the boxes' to ensure your super does not land up in the wrong hands!!



20.01.2022 Any person that thinks DIY Wills are easier and cheaper than engaging a Lawyer (experienced with drafting Wills) should consider the key points in this article. At the end of the day, its the Lawyers that 'reap the rewards' of human error when DIY Wills are used!

18.01.2022 **HOMEMADE WILLS** Again recently cursed by the Supreme Court of Western Australia To quote Master Sanderson of the Supreme Court in a recent WA Court Case (taken from his opening comments in the Judgement in Keddie vs Baldrey [2018] WASC 206): MASTER SANDERSON:... "There are three great evils which bedevil Probate practice. First and by far ***the most egregious is homemade wills***. Second there is the problem occasioned by no will at all and the effects of the blunt instrument that is the Administration Act 1903 (WA). Third there are those cases where there is a will but the testator's circumstances have changed and the will has not been updated." See more



18.01.2022 Aretha dying without a Will and her family rallying to protect her legacy is a **VERY RARE** situation!!! When a person dies without a Will, their estate is dealt under intestacy legislation (certainly in Australia) and often, such outcomes can lead to unwanted results. A spouse may not receive everything as is often the misconception. And, family disputes may occur which can incur hefty legal fees for the estate. The easiest (and often cheaper) option to is have a Will. A Will provides certainty and the process of dealing with the estate may less complicated.

18.01.2022 Some interesting (or is that scary!) stats from Paul Clitheroe on how many Australians do not have a Will. A key point that Paul makes in his article is "the research did not cover how many Australians have a Will that accurately reflects their current situation." Not having a Will is heading for disaster. Having a Will that does not reflect a person's current situation is also 'problematic.' Paul's take home message -: Get your Will done or get your Will updated. Contact us for both.

In short, getting a Will (prepared by a Lawyer) that considers all potential situations and provides for your loves ones is 100% more secure than a DIY Will Kit...! Plus, engaging a Lawyer to prepare your Will is much cheaper than the legal fees that will be incurred if your (DIY) Will ends up in Court.

14.01.2022 A worthy article: If you are in a same-sex relationship and planning to marry, check your superannuation nominations. Your fund may have a 'life changing' clause that may may apply when you get married! If you have a SMSF, also check your Trust Deed for any clauses that may affect your nominations when you get married. IN SUMMARY...if you plan to get married, it's vital to get your Will and other estate planning documents done.

04.01.2022 An interesting article on the outcome of a son's challenge to his mother's Will. The son sought $450K from his mother's estate but the Court only awarded him $75K. However, the noted comment by the Judge was the amount of legal fees that the son and the Executor (the mother's other son) incurred (being $160K and $140K respectively) "were disproportionate to the outcome of the proceedings." While no Will is 'challenge proof", it is still better to have a legally prepared Will than not. if you want to get your Will or you have concerns about your current Will, contact us.
