25.01.2022 Dodgy Work Diaries: Causing FALSE Breaches: SARTA was made aware by members today that there is a batch of FAULTY Work Diaries out there and that when drivers t...ry to have them replaced they are being told that the books are all like that so the agency wont change them until the new stock arrives. The problem is that the yellow and pink pages are all out of alignment by 15 mins compared with the top white page and they show all times marked by the driver as 15 minutes earlier. So what????? Well this could lead to false breaches by officers and in-house checking. For example a driver who actually starts work at 5am and has rested since 10pm the night before, to ensure they have a legal NIGHT REST, will actually show on the Yellow and Pinks as having started at 4.45am and so NOT had a Night Rest. This could lead to an apparent failure to meet the Night Rest requirements of 4 NRs in 14 days. There are other potential breach problems too, including apparent Work Diary misalignments with SafetCam timings. SARTA has raised this with the NHVR and DPTI as soon as we heard about it (it’s a pity and very disappointing that we didn’t hear about it from any government source though as they obviously knew about it). The NHVR and DPTI have advised us that: They are working on resolving this issue and will comeback to us asap; They are looking at how best to ensure that drivers and operators are not issued with incorrect infringements and what to do if a driver/operator thinks that a breach is false because of the misaligned Yellows and pinks. We are aware from operators that some of you have been advised to use inappropriate solutions, like getting drivers to hand in their entire Work Diary (making it impossible for them to drive again until the checking has been done . Impractical) and/or to photocopy the white pages (se WE get to pay massively as an industry for faulty Government Work Diary products for which we have been charged good money). Happily senior officers of both the NHVR and DPTI acknowledge that such ‘solutions’ are not realistic, nor are they fair. We have made some suggestions regarding enforcement policy to try to guard against false infringements being issued and we will continue our constructive discussions with NHVR/DPTI and SAPol about this next week. If you have any issues with law enforcement where these faulty Work Diaries have affected the situation, contact SARTA for advice and help.
