20.01.2022 The QPU supported and funded Senior Constable David Caffrey’s legal challenge that has now created a legal precedent in Queensland that supports our members who... suffer psychiatric injury from attending traumatic road crashes. The CTP insurer had argued that police should NOT be owed a duty of care given that their attendance at an accident is part of their employment. The Supreme Court rejected that argument and supported Senior Constable Caffrey resulting in the CTP insurer appealing the decision. The Court of Appeal also rejected the insurance company’s case and determined that police are owed the same duty of care by a negligent driver, that is owed to every other member of the public. The insurer's time frame to seek special leave to Appeal to the High Court has now expired and the matter is at an end. Due to the actions of the QPU funding this case, it now creates a legal precedent that will provide great support for police well into the future. Should any member require any further information regarding Workcover matters, psychiatric injuries and potential CTP claims they should contact the QPU straight away and we will work with our expert Ryan Heath from Sciaccas Lawyers .
