14.01.2022 Client held BVE from student visa cancellation. Applied onshore partner visa, which is not allowed unless you have compassionate and compelling reasons. If we didn't win this case, client had to leave, and could not come back to Australia for at least 5 years due to previous cancellation, and also due to COVID, it would have been a disaster for this couple to live apart indefinitely. After 3 hours of hearing, a very long submission letter, and yes! They remit the decision ...back to the Department and partner visa granted in 1 day! Winning at AAT is all about the submission. 10.01.2022 Federal Budget being delayed til October, most States are holding off on nominations for 190 and 491. WA migration is still taking Nomination applications as normal and processing normal, yet invitation for visa may be in delay. If your visa is expiring before December 2020, you need to start looking at option to secure a valid visa to stay while everything is being confirmed. Consider 407 as usual.
