25.01.2022 Prior to the mid 1980’s, asbestos was used as a component in an extraordinarily wide variety of products found in both the workplace and the home. Because asbestos related diseases usually develop at least 30 years after initial exposure, it is important to be aware of the risk and have regular health checks if you think you may have once been exposed to asbestos fibres. Segelov Taylor Lawyers are legal experts in asbestos exposure and can advise you about your options if you think you have an asbestos related claim.
24.01.2022 A common question we are asked by clients is what the effect on a age or other Centrelink pension is if a person makes a claim for compensation for asbestos disease. Tanya provides a response in this blog post..
23.01.2022 Another kind letter we received. We are always delighted to help our clients. If you need any assistance, please give us a call on 02 8880 0500.
22.01.2022 Most people diagnosed with mesothelioma today were last exposed to asbestos 30-50 years ago. However, the danger of asbestos has not gone away. Segelov Taylor client, Mr D*s exposure to asbestos in the workplace only ended in 2017 when he was diagnosed with mesothelioma and became unable to work. *Names have been changed

20.01.2022 There seem to be stories about dumping asbestos materials (or about dumped asbestos materials being found on a building site, or park, or in the bush, or about increased fines for dumping) almost everyday. While the dumpers should be prosecuted, the underlying problem is not being addressed. Governments have made it incredibly expensive and difficult to dispose of materials containing asbestos safely. They should provide assistance, training and subsidies to get rid of th...ese dangerous materials. The effect of these policies is a marketplace where unscrupulous individuals who are willing to risk lives by disposing of old asbestos containing materials in public places can charge a great deal for removal, and obtain great profits for themselves. If the cost of asbestos disposal was reduced , this incentive would disappear. The amount of these dangerous materials dumped unsafely would also be reduced. See more

19.01.2022 A kind letter we received from Mr Crosby.
19.01.2022 It almost looks like it’s been forgotten. There are two chapters [in the report]: executive remuneration and frontline staff," Mr Taylor said. There’s a lot of people in between those two groups [who] drive the culture, set the standards, set the expectations ... What is expected of those things remains unclear." Representing the Finance Sector Union, David Taylor makes it clear the Hayne Royal Commission left plenty of questions open.
19.01.2022 Segelov Taylor principal, Tanya Segelov was interviewed for an article in the Age & SMH about the third wave of asbestos disease and National Asbestos Awareness Week. 18.01.2022 In the first WA mesothelioma matter to run to judgment in over a decade, Segelov Taylor Lawyers was successful in securing $1.04m in damages for Ms Parkin. Despite WA having such high rates of mesothelioma, compensation to WA asbestos victims has consistently been below the standard of other states. The case is a major victory for all WA mesothelioma sufferers.
17.01.2022 Tanya Segelov discusses her most recent Supreme Court win, and how the case sets a powerful precedent for how general damages are calculated for mesothelioma victims in WA.

15.01.2022 Devastating, especially given it doesn’t include the effect of 1 in 8 workers not being paid their full super. http://www.smh.com.au//100-billion-wipeout-one-in-four-wor
14.01.2022 Recent examples of what appear to be preventable deaths in the workplace speak to the need for something more to be done to ensure that employers take their obligations around workplace safety seriously. Industrial manslaughter legislation is one possible solution. Segelov Taylor Lawyers are specialists in employment and industrial law and can advise unions and employees on obligations and rights that arise under the Work Health & Safety Act.

14.01.2022 The third wave of asbestos disease will mean more women, and DIY renovators are faced with mesothelioma. https://goo.gl/8wrgks
14.01.2022 This story about what is going on at the Springwood depot is alarming. The negative effects of the removal of union's rights to take action under Work Health & Safety legislation continues to leave workers exposed, as does complacency and a failure to understand that there is no level of exposure to asbestos that is safe. https://goo.gl/WDJhso
13.01.2022 Ms Parkin told The West Australian she hopes her major win against James Hardie's Amaca fund will "help people after me, especially in WA, because it's a disease that has got a bit lost". Read further in the article.

In a decision handed down by the Court of Appeal, the Court found there was no constraint to damages for loss of capacity to provide domestic services under s 15B of the Civil Liability Act. Read our post below to understand what this means for mesothelioma claimants.

08.01.2022 As a general proposition, discrimination in employment is illegal. However, at both the state and federal level there are key exemptions for religious schools that allow them to discriminate against employees and students on the basis of sex, sexual orientation, gender identity, marital or relationship status or pregnancy. The law is in urgent need of change.
08.01.2022 Exposure to asbestos can result in the development of a range of illnesses and medical complications. There is no such thing as asbestos cancer, although exposure to asbestos can be linked to the development of certain types of cancers. If you develop an asbestos related illness, it is important to seek legal advice so that you are aware of your rights. Segelov Taylor Lawyers can help.
07.01.2022 This gender pay gap, which is not really getting better, is just looking at the difference in pay for the same work. The difference for different work (eg nurses, teachers, etc) of the same value is even worse. https://goo.gl/3icHeQ
07.01.2022 The need to compare this to scurge of asbestos is unhelpful. However, it beggars belief that medium and high density buildings can be approved with such obvious and severe fire risk.
07.01.2022 Segelov Taylor principal, David Taylor, speaking earlier this month at the AMIEU NSW Branch Delegates Conference on the topic of workers rights under the Fair Work Act.

06.01.2022 The woman on maternity leave is almost always the one selected from a team to be terminated for redundancy. Its a function of the fact they are absent from the workplace, and therefore its easier to sack them, and also that they are likely to have limitations and request some flexibility on their return. It is also illegal. https://goo.gl/2MuVdk

05.01.2022 It is interesting how the courts are dealing with the changing ways we communicate and record our wishes. However, underlying this is that avoidable and unpleasant litigation arose because the will was not is a clear form. https://goo.gl/xw5yrQ
