24.01.2022 There is a lot of misinformation out there about the long term consequences of visa cancellation on 'character' grounds under s 501. Let us be clear: if your visa is cancelled under s 501 and that decision is not set aside, you will be permanently unable to return to Australia. We've written the below article explaining the situation in more detail. Obviously, this makes fighting the visa cancellation process all the more important. Book a free initial consult with us now to get accurate advice on the visa cancellation process and the timeframes involved: https://sentrylaw.com.au/free-consult

24.01.2022 Last week we wrote about the long-term consequences of cancellation under s 501. This week we write about the long term consequences of cancellation under s 116(1)(e). While the consequences of cancellation under s 116(1)(e) are not as extreme, it is by no means certain that you'll be able to return to Australia once the relevant exclusion periods have expired. Check out the below article for more info. As always, you can book a free initial consultation to get advice specific to your circumstances here: https://sentrylaw.com.au/free-consult

20.01.2022 New Zealand citizens in Australia, we're talking to you! There are over 600,000 NZ citizens in Australia at any one time. Most hold a kind of visa called a Special Category Visa. It is a weird visa because it is a 'temporary' visa of indefinite duration. This has some unique consequences for NZ citizens in Australia, which we discuss in the below article. If you're an NZ citizen in Australia and would like to discuss your pathway to permanent residency and/or citizenship, book a free consultation with us here: https://sentrylaw.com.au/free-consult

19.01.2022 After two and a half years in detention, our client is finally able to go home and see his kids! Although his initial request for revocation was unsuccessful, Sentry Law successfully appealed to the Administrative Appeals Tribunal to overturn this decision and get our client his visa back! Our client was lucky enough to have a great support network that worked with us to ensure we could put his best case forward. ... If a family member or someone close to you is facing visa cancellation, don't underestimate the impact your help and support can have. We work closely with our clients' families to maximise their chances of success. Book your free 20-minute consultation with one of our lawyers right now: https://sentrylaw.com.au/freeconsult

17.01.2022 We are always thankful to receive positive reviews from our clients and their families. But honestly, our job is made so much easier by the fact that all the people we work with (whether they be clients, their families or friends) are always willing to work with us to put forward the best case possible.

17.01.2022 Last week we wrote a blog about how (for the moment) non-citizens who have been unlawfully removed can suffer significant future consequences (especially NZ citizens). This week we write about why Parliament should not attach legal consequences to unlawful actions undertaken on behalf of the Government. If you have had a visa cancelled, or are facing removal from Australia (or have already been removed), we encourage you to book a free initial consultation with our firm here: https://sentrylaw.com.au/free-consult

16.01.2022 We're always happy to get stuck into some of the weirder and more complex migration problems out there. Thanks for giving us the opportunity to get off-the-beaten-path to help you, Ed!

16.01.2022 A few weeks ago we posted a blog about the unique position of NZ citizens within Australia's migration system. One of the issues faced by New Zealanders not faced by other long-term residents is the risk of onshore cancellation with only limited notice under s 116(1)(e). This week's blog asks the question - Should NZ citizens in Australia be subject to this risk of cancellation? As always, if you or someone you know is facing visa cancellation, please book a free initial consultation with our firm now: https://sentrylaw.com.au/free-consult

16.01.2022 Happy to have helped another client get their visa back at the Administrative Appeals Tribunal! Dealing with visa cancellation processes, especially when there are ongoing criminal charges in the mix, is always a bit of a complex task. Luckily we're always happy to get stuck in, speak with the criminal lawyers, and work out the best way to approach things. If you or someone you know needs some information about a visa cancellation or refusal, or some other type of complex visa matter, you can book your free 20-minute consultation with one of our lawyers right now: https://sentrylaw.com.au/freeconsult

15.01.2022 As we head towards Christmas, we're extremely thankful that we were able to assist a client to obtain a positive result at the Administrative Appeals Tribunal. He will now be able to head home and spend Christmas with his partner and young daughter. While it is true that successfully applying to the AAT for review of a non-revocation decision is not straightforward, it can be done. If you or someone you know would like to speak with us about a visa or migration issue you have, please contact us on 1300 148 652 or book a free consult with us here: https://sentrylaw.com.au

15.01.2022 As you can probably tell, we don't like talking about ourselves much. Thankfully, people like Ondilla are happy enough with the work that we do that they're willing to write reviews.

13.01.2022 This week's blog post is about an interesting case we ran last year (and which is currently under appeal). If you have previously been unlawfully removed from Australia, do you now fail to meet a visa criterion that requires you to not previously have been removed? For the time being (according to the FCCA) the answer is yes. Stay tuned for the outcome of the appeal to the Federal Court. If you have a complex migration matter that no-one else knows what to do with, feel free to book a free initial consultation with our firm (https://sentrylaw.com.au/free-consult). We might not know the answer straight away, but we always love the challenge of finding answers to unique and unusual problems.

12.01.2022 As a firm, we pride ourselves on acting across the full spectrum of migration law matters: From making written submissions to first-line decision-makers to applying to Courts for judicial review (and everything in between). When applying to the AAT for review of a decision, it is asking 'What is the preferable decision to be made.' However, when it comes to applying to a Court for judicial review, one of the hardest things to explain is that the Court is not concerned with wh...ether the 'right' (or 'preferable') decision was made, but only whether the decision was 'lawful.' As we discuss in the below article, these are two very different questions. As always, if you need assistance applying to the AAT or to a Court for judicial review, you can book a free initial consultation with one of our lawyers here: https://sentrylaw.com.au/free-consult See more

12.01.2022 It's always nice when a client has nice things to say about us. Thanks Manon!

12.01.2022 Question: Were your children born in Australia to parents who were both temporary visa holders (including Special Category Visa holders)? If so, your children did not become Australia citizens at the time of their birth, but might automatically become citizens on their tenth birthday. To find out more, check out this week's blog post below! If you'd like more info, book a free consultation with us right now here: https://sentrylaw.com.au/free-consult

12.01.2022 Another week, another blog post. This time, we attempt to address a common misunderstanding: Just because the Minister has the power to cancel (or refuse) a visa, doesn't mean that the Minister will cancel (or refuse) a visa. 11.01.2022 Some good news amongst all the Coronavirus/COVID-19 developments! One of our clients received a positive revocation decision this afternoon . This means that instead of facing immigration detention and removal on her release from prison, she will be able to head home to her kids and grandkids. Having a visa cancelled under s 501 of the Migration Act is a difficult process to face, but with the right advice and guidance it is not all doom and gloom. If you or someone you know is facing visa or migration issues, don't hesitate to contact us on 1300 148 652 or book a free consultation here: https://sentrylaw.com.au/free-consult

10.01.2022 Do you need a lawyer? No. Should you get a lawyer? Maybe. Should you speak to a lawyer? Definitely. This article discusses the reasons if, when, and why you should get a lawyer to act on your behalf in a visa cancellation or refusal matter. Find out why we generally recommend getting a lawyer before the appeal stage. 09.01.2022 Every week or so we post a new article about our experiences acting in complex migration law matters. But what is migration law, anyway? For us, that is an important question, because we are regularly asked by clients, their families and members of the general public: "How does a random politician have the power to tear families apart?" Since, "Because section so-and-so of the Migration Act" isn't a particularly helpful answer, we've tried to write an article about what Migration Law is and how it fits into Australia's broader system of laws. 09.01.2022 A few days ago we posted about being able to get the Minister to back down on his threat to cancel our client's visa (unlawfully). This week's blog post is about a neat trick to avoid the Minister's power to set aside a favourable AAT decision and cancel a non-citizen's visa. If you're facing visa cancellation or heading to the AAT, schedule a free initial consultation with us now: https://sentrylaw.com.au/free-consult

07.01.2022 This week's article is a weird but important one. When dealing with a visa cancellation case, decision-makers are sometimes required to accept the findings of a criminal court, even when there is clear evidence that the Court's findings were wrong (including where the victim of an alleged murder walks into an Administrative Appeals Tribunal hearing room). Read our practical summary of the recent Court decision in HZCP v Minister for Immigration and Border Protection. 07.01.2022 A bit of a proud day for our firm. We managed to get the Minister for Home Affairs to back down on a plan to unlawfully cancel our client's visa before the decision was even made (why spend time in immigration detention if you don't have to?)! If you've been notified of an intention to consider cancellation of your visa, get in touch with us now to find out if we can prevent the Minister from making a decision!

06.01.2022 Incredible news for our client in this groundbreaking decision from the Federal Court For 2+ years our client has been fighting to return to her normal life in Australia after being wrongfully removed by the Minister for Home Affairs. Stay tuned for more information about what this win will mean for others who have been wrongfully removed!

03.01.2022 Trying to work out Australian visa cancellation processes can be a difficult task because there are so many different ways a visa can be cancelled. We've written the attached article to help makes things easier to understand.

02.01.2022 We're so thankful that people trust us to act for them when it comes to such extremely consequential and stresful matters.

02.01.2022 It was a long road, but we made it! Thanks for sticking with us over the long run Lorenzo!
