24.01.2022 Born in Australia? Following the Tamil family matter in the news? Unlike America, being born in Australia does not make you Australian.... Unless one or both parents are Australian citizens or permanent residents, the child will acquire the citizenship status of the parents. This changes however if the child remains in Australia until their 10th birthday at which stage they can apply to be an Australian citizen provided they can prove they have resided here and went to school here. There are not many situations that allow anyone to stay in Australia for 10 years sorting out their Australian visa but it does happen from time to time. In all other situations, the baby must be included in the parents Australian visa application. If a visa is refused or denied the applicant may have review rights. Check the letter from Immigration to see if you have review rights. If you have review rights then the matter may proceed to AAT & if unsuccessful there, may possibly be able to move through the Australian court system. The Minister also has the right to intervene but they rarely do. Once your matter has exhausted all possibilities and if you have been unsuccessful, then you will be asked to leave Australia. A Section 48 Bar will be imposed usually at the airport upon your departure stopping you from re-entering Australia for a certain period and you may also have a Debt to the Commonweath which must be repaid if you want to apply for another Australian visa. Currently the Australian Government require an immigration lawyer to have dual registration as lawyer & as a Registered Migration Agent. 24.01.2022 Breaking news: Australia has banned non-essential gatherings of 100 or more people indoors as it declares a human biosecurity emergency. Prime Minister Scott Morrison said the states will be tasked with implementing the restrictions on social gatherings. The ban is effective immediately.... Restaurants, pubs, bars, sports clubs, RSLs and other venues are all set to be hit with the ban. Airports, trains, trams, buses, correctional facilities, courts, supermarkets, grocery stores, retail stores, shopping centres and workplaces will be exempt. As will education facilities, including schools, universities, and child care facilities. Mr Morrison said Australias travel ban had been lifted to level four for the entire world. Mr Morrison said Australia should prepare for at least six months of disruption as health authorities attempt to get on top of the coronavirus.

If you come across a damaged or poorly maintained public sidewalk, you should photograph it and report it to your local Council. Many Council web sites now have a section where you can report public hazards. Perform a civic duty and protect our community.
24.01.2022 Insurers are not required to assess your MVA claim for 18 months - 2 years after the accident. During this time they are all issuing certificates to say every claim is a "minor injury" in a bid to knock out every claim. Please retain a lawyer early, seek treatment and if your GP refers you to a specialist or rehabilitation then undergo the treatment. The Insurers are counting on you doing nothing. Do not fall into that trap.

What they dont tell you is that NOBODY is using it and it is largely a WHITE ELEPHANT. The Governments response is to FORCE Lawyers and Banks etc to use the system and it will become mandatory by July 2019. Say NO to e-Conveyancing. The systems currently in place does not safeguard multi million dollar property transactions. What if the money you were paying to buy your house or unit..ended up in someones account.... Missing one number or one letter during a monetary transfer can mean that your money ends up in someones account. How will it be recovered? How long will it take to recover bearing in mind the Contract imposes an interest sanction (usually 10%) when settlement does not occur on time. Will it ever be recovered?

18.01.2022 Concerns over the NSW Government's CTP Scheme The Law Society is becoming increasingly concerned that the NSW Government’s CTP Scheme is depriving people who are genuinely injured in motor vehicle accidents of appropriate benefits and compensation, despite the legitimacy and accepted reality of their injuries. When the NSW Government’s proposal for a minor injury test was first put forward in 2017, the legal profession raised strong concerns. At the time the Law Society advoc...ated that upholding fairness for people injured in motor vehicle accidents should be the primary objective for the new CTP Scheme. However, as outlined in the Law Society’s submission to the review of the minor injury definition contained in the Motor Accident Injuries Act 2017, in the 18 months since the minor injury definition’s introduction, anecdotal evidence from our members, doctors and claimants suggests that many genuinely injured people are now being excluded from adequate compensation. The Law Society is also concerned that the high number of minor injury assessments 58 per cent of the 12,444 claims as of 30 July 2019 reflects the unreasonably low threshold for meeting that definition. Apparently the overall claims numbers to date are well below the projected claims figures and the Law Society query whether this could be leading to excessive insurer profits. Their view, supported by the work of the Law Society’s Injury Compensation Committee, is that if there is to be any adjustment of the CTP Scheme, based on the meaningful review of claims data compared to projected outcomes, it should be to increase access to benefits for injured people, rather than simply reduce the price of Green Slips in NSW.
18.01.2022 COVID-19 IMMI WEB SITE: Cruise ship passengers As at 15 March 2020 the Australian Government restricted all cruise ships from entering Australia for 30 days, inclusive of direct arrivals and Round Trip Cruises.... All travellers entering Australia from 0001 AEDST 16 March 2020 must undertake a precautionary self-isolation period for 14 days upon departure from your last overseas port. We are working with the cruise industry to: implement the restriction bring everyone currently on a cruise safely back to port and to their home destinations either in Australia or overseas. Cruise ship crew must self-isolate for 14 days* or for the duration of their stay whichever is shorter. Australian citizens and residents may complete a domestic transfer and commence their 14 day* self-isolation period in the final destination. While in transit, they must remain in the airport or if they have a layover, they must self-isolate in their accommodation for that transit period. * Please note that the 14 day period commences from the day of departure from the last port of embarkation. As an example, if a ship has travelled for 10 days prior to arrival in Australia, the self-isolation period will only be the remaining four days. This is only applicable provided no crew member falls ill or displays symptoms of illness

We have issued this advice for two principal reasons: There may be a higher risk of contracting COVID-19 overseas. You may come in contact with more people than usual, including during long-haul flights and in crowded airports. Health care systems in some countries may come under strain and may not be as well-equipped as Australias or have the capacity to support foreigners. You may not have your normal support networks overseas. Overseas travel has become more complex and unpredictable. Many countries are introducing entry or movement restrictions. These are changing often and quickly. Your travel plans may be disrupted. You may be placed in quarantine or denied entry to some countries. 11.01.2022 Major Partner and Family Visa Legislation Passes Senate & the affect on Partner/Fiance Visas is now uncertain. Of specific concern is the anticipated change that the sponsor part of partner and fiance visa application may have to be lodged and approved prior to visa applicants making their application. If this becomes law it will delay processing of onshore partner visas. Heads up for those on visitor visas lodging an application for a partner visa.

06.01.2022 CORONOVIRUS UPDATE The National Security Committee of Cabinet has today decided that the continuing coronavirus infections in mainland China make it necessary to continue the travel restrictions on foreign nationals entering Australia for a further week to 29 February. The continuation of the travel restrictions means that for a further week, foreign nationals excluding Australian citizens and permanent residents who have been in mainland China will not be allowed to enter Australia for 14 days from the time they left mainland China.

03.01.2022 Changes Announced to Temporary Visa Holder Arrangements - Covid-19 In line with changes being made for Australian citizens and permanent residents, most temporary visa holders with work rights will now be able to access their Australian superannuation to help support themselves during this crisis. Temporary visa holders who are unable to support themselves under these arrangements over the next six months are strongly encouraged to return home. For these individuals it's t...ime to go home, and they should make arrangements as quickly as possible. However, if you form part of the key industries such as health, aged and disability care, agriculture and food processing, there have been certain changes which are geared toward enabling temporary visa holders to remain in such roles as such workers can help boost front line health numbers, get food from farms to our shops and ensure critical services continue. The following new measures will apply to the major classes of temporary visa holders. The situation will be reviewed periodically and further changes made if required.
02.01.2022 BREAKING NEWS: CTP Insurers have been accused of pocketing almost $4 billion dollars in the past 16 months at the expense of injured motorists in NSW since our state government reformed its personal injury compensation scheme. We recommend that our injured clients affected by the new scheme which allows CTP Insurers to delay assessing a claim for 18 - 20 months, to send us letters so that we can refer your complaints to the necessary authorities.
