21.01.2022 Judgment Just In: The Court of Appeal has rejected a challenge to a decision of the Supreme Court of New South Wales holding the Coffs Harbour City Council lia...ble in negligence for personal injury suffered by a 5-year-old boy who fell through railing on the Coffs Harbour Jetty onto hard sand below whilst walking with his grandparents in 2011. The Council was held liable on the basis that it had had control and management of the jetty since it was handed over to the Council by the State Government in 2002, knew of the risk of children falling from the jetty onto hard sand, and should therefore have taken precautions such as filling gaps in the railing with mesh or wiring. The Court of Appeal held that the primary judge was correct in holding the Council had been negligent, and that neither the State nor the grandparents could be held liable, in circumstances where the State no longer had management of the jetty and the grandparents had not been shown to have acted unreasonably. The Court found that the relevant promise was for the transfer of two properties in Louisa Road, Birchgrove; not for the entirety of the estate (valued at approximately $11 million), and ordered that the properties should be transferred to Mr Moore and Ms Andreasen. 01.01.2022 Wednesday 25 November is the International Day for the Elimination of Violence Against Women. It also marks day one of the global #16Days campaign, which aims t...o raise awareness for 16 days to help prevent and eliminate violence against women around the world. Violence against women continues to occur at an alarming scale. Too often it is accepted as normal behaviour and cultures of discrimination against women allow violence to occur with impunity. Calls for action like the 16 Days of Activism help to shine a spotlight on and create public awareness about what needs to change to prevent it from happening in the first place. Join us in the #16Days Campaign by liking and sharing this post, and learn more about the campaign here: https://iwda.org.au/what-are-the-16-days-of-activism-and-w/
