19.01.2022 A woman, who was left out of her father’s Will, has been awarded $800,000 from his $6m Estate. In considering her claim the Court took into account various factors including the daughter’s dire financial position. The Court was not swayed by the Defendant’s argument that the daughter’s lifestyle justified her exclusion from the Will. The recent matter of Hutchison Ports has provided some guidance on what the ACCC considers to be an unfair contract under the business-to-business unfair contract regime in the Australian Consumer Law. The matter involved the provision of an enforceable undertaking by Hutchison and is relevant to all businesses who use (and those who are required to accept) standard form contracts. Labour hire providers (including recruitment agencies) will need to obtain a licence during the transition period. 11.01.2022 If you are the recipient of a conditional gift under a Will, you may wonder whether the conditions enforceable? Many gifts in Wills contain a simple condition such as the beneficiary must reach the age of 21 years. However, more complex conditions are possible. In one US case, a husband left his Estate to his wife on the condition that she smoke 5 cigarettes a days for the rest of her life. Apparently, this condition was pay back for years of complaints about the husband’s smoking habit.
