22.01.2022 JobKeeper employees can be asked to take annual leave, and we know that many have been. Now that we’re a few months into JobKeeper, you might be looking at your... decreasing leave balance and wondering whether you can save some leave for when travel restrictions ease. The JobKeeper rules in the Fair Work Act say you can be asked to take annual leave, but you have to keep a balance of at least 2 weeks. So if your leave balance is getting down towards the 2 week mark, now is the time to start a conversation with your employer about what’s next. 22.01.2022 Your boss can ask you for evidence for paid sick leave, but that doesnt mean you have to tell them private medical info. Evidence for sick leave only needs to... convince a reasonable person that you were unfit for work due to illness or injury it doesnt have to say what that illness or injury was. We dont consider it reasonable for an employer to contact your doctor for further info. And it isnt reasonable for an employer to go to a medical appointment with an employee unless an employee requests this. If you have a contagious illness that poses a risk to your co-workers, seek advice from your state-based workplace health and safety organisation about whether you should also provide evidence that it is safe for you to return to work (like a clearance certificate).

09.01.2022 Here are our top five things that should scream warning! in a workplace. 1. Youre not paid for all the time youre required to work. That means pay for ma...ndatory team meetings, opening and closing the business and working trial shifts (if beyond whats reasonably required to demonstrate the skills for the job). If youre not getting paid for all the time youre required to work, somethings wrong. 2. You dont get a pay slip. This is a common issue we see. Your boss is required to give you a pay slip for every pay day. If youre not getting one, make sure you keep your own records of when you work this can help in disputes about pay. Our free Record My Hours app can help you keep a record (just search for it in the Apple or Google Play stores). 3. Your boss wont tell you what your award or agreement is. Awards and agreements set out your minimum conditions like pay and when you get breaks. If your boss has an issue with you knowing this info, its not a good sign. 4. Youre not allowed to take breaks. If you work in retail or hospitality and work more than 5 hours, youll generally be entitled to an unpaid 30 minute break and may get a paid rest pause as well. Check your award or agreement to see when you get paid and unpaid breaks. 5. You get paid off the books. If you get paid cash-in-hand so you dont get super or pay tax, its unlawful. 08.01.2022 The Fair Work Commission has announced a 1.75% increase to minimum wages. This will apply to all award wages. Increases to awards will start on 3 different da...tes for different groups of awards. Frontline and essential services get the increase from 1 July, 2020. Manufacturing and construction award wage rates will be increased from 1 November, 2020 and accommodation, food, retail, tourism, and aviation will be increased from 1 February, 2021. For anyone not covered by an award or an agreement, the new national minimum wage (NMW) will be $753.80 per week or $19.84 per hour. The increase to the NMW applies from the first full pay period starting on or after 1 July 2020. 07.01.2022 An employer receiving JobKeeper payments can ask an eligible employee to work additional hours, but the usual requirements in the Fair Work Act apply. Any addit...ional hours worked need to be reasonable, and you can refuse to work unreasonable additional hours. If the only reason for a request to work additional hours is to match the amount of the JobKeeper payment, that is not likely to be reasonable. Your employer also needs to comply with any other terms and conditions of employment that apply to you (like the rules from your award, enterprise agreement or employment contract). Your employer must pay your usual base rate of pay for the additional hours, as well as any penalty rates or overtime pay that may apply. To decide whats reasonable you should consider: your personal circumstances, (eg. family responsibilities) whether youll get more pay (eg. penalty rates) the needs of the workplace the type of work you do whether your salary includes work on a public holiday whether youre full-time, part-time, casual or a shiftworker how much notice youre given about working the amount of notice you give when refusing to work.
