With an estate rumoured to be as worth as much as 400 million, his expectant beneficiaries are waiting with outstretched hands as French authorities investigate Lagerfeld’s complex asset structure, with suspicion that his various entities spanning the UK and Europe have been avoiding paying tax. To make matters more interesting, many are speculating tha...t Lagerfeld would have attempted to leave a sizeable amount to his cat Choupette, as he had previously famously stated he would. The ability to leave a portion of an estate to beloved family pets is actually a common question, and will makers often go to great lengths to ensure their ‘fur babies’ are well looked after when they go, but unfortunately, an animal cannot inherit as animals are not people, and are more accurately legally defined as property. 25.01.2022 Celebrity multi-millionaire estate disputes in the news (yet) again. This time it’s the late Hollywood producer and noted philanthropist Steve Bing who died this week, reportedly by a tragic suicide. Bing’s fortune, worth somewhere north of half a billion dollars is now up for dispute.... This case is not simple. They never are - but here, arguments have been raging for years already around the family money (Bing inherited a huge amount of his wealth at the tender age of 18) - and claims of paternity cases for his illegitimate children. One child, Damien, is the son of actor Liz Hurley and was proven by DNA to be Bing’s son. Another, Kira Kerkorian (whose father Kirk Kerkorian is a noted billionaire) was also found to be Bing’s daughter when a Private Eye hired by Kirk Kerkorian found Bing’s used dental floss in his garbage and tested its DNA. It’s not just that we are fascinated with celebrities - its that celebrities seem to have such incredibly complex lives. But the reality is their lives are no more complex than ours - its that there is just usually more at stake. Many of the issues that play out in these celebrity cases such as Will disputes, DNA testing for illegitimate children, fights over inheritance and family trusts, play out in Court cases of so called ‘ordinary families’ too. It brings home the fact that humans all lead complex lives - estate planning, Wills and trusts are all things that even us mere mortals need to take seriously, or avoid living in what might otherwise look like a celebrity drama.

19.01.2022 The nation is still in the throes of Covid-19, with the State of Emergency still in force. However, the moratorium on landlords evicting tenants that has been on foot since March expires in about a month a half. That means many tenants will be at risk of eviction from October 1. Some tenants have been able to negotiate rent deferments during the last few months, but those will also come to an end soon too.... The net effect is there could be a lot of sudden evictions, but that depends entirely on the particular landlord, many of whom have also suffered severe financial losses during the pandemic. In WA, our necessary hard border with the East has sadly caused significant pain to the tourism and arts sectors in particular - and lots of workers in those industries have been hit very hard. Landlords may want to think twice about a sudden eviction at the moment as the hard border looks like it will remain in place for some time to come, and which means there may not be any new renters to take up an empty space. It is expected there will be some difficult discussions between landlords and tenants soon, if there haven’t already been. 07.01.2022 The High Court allowed the release of the Palace Letters today, against the wishes (and Court arguments) of the Federal Government and the Palace itself. The Letters are fascinating, and a little disturbing. Whilst they confirm that the Queen did not know about the Dismissal of the Whitlam Government before it happened, they also confirm that she was kept abreast of the entire situation right up to the event itself. The Palace Letters drag back up the whole incident of the D...ismissal and recontextualise it for us - a unique event in Australian history and now a unique perspective, from the man behind it, Governal General Kerr. The importance of these letters cannot be overstated - they allow a secret window into our nation’s history that has long been denied to us, but also reframe the whole question of our constitutional monarchy, and what place it has in modern Australia. The Australian archivist Jenny Hocking, who won the High Court appeal allowing the release of the Letters, has a very interesting take on it here.

05.01.2022 Can I get out of my contract because of tough economic conditions? This news article involving Under Armour and the University of California looks set to test the limits of clauses that allow parties to terminate a contract as a result of tough economic conditions following COVID-19. It is suggested that Under Armour is seeking to terminate the contract with UCLA due to, amongst other reasons, the tough economic climate caused by the pandemic. Given the amount of money invol...ved, this is likely to play out in the Courts in the US over the next few years. Our advice is that before you seek to terminate a contract, do seek legal advice to make sure that you have grounds to terminate before you do anything else. You also need advice about the consequences that may flow from a termination, which could include a claim by the other party for breach of contract - ie whether you may be liable to pay damages, or if the other party may seek Court orders to prevent you from terminating the contract (an injunction) and requiring you to perform your obligations under the terms of the contract (an order for specific performance).
