16.01.2022 Thankfully, the High Court has clarified the way personal/carer's leave is accrued and taken under the #FairWorkAct, and good sense has prevailed. In August 2019 the Full Federal Court made employers pull their hair out by finding that the entitlement to paid personal leave is to be based on 10 working days per year rather than a proportion of ordinary hours worked. This meant that an employee who worked three 12 hour shifts per week was entitled to be paid for 12 hours per d...ay of personal leave rather than their average ordinary hours of 7.2 hours per day. This was contrary to the long standing approach to accrual of personal leave and many employers have been waiting for the outcome of the High Court appeal before changing their payroll practices. The High Court rejected the Full Federal Court's approach. It found that the 10 days of paid personal/carer's leave per year must be calculated by reference to an employee's ordinary hours of work. The entitlement to 10 days is to two standard five-day working weeks. This means that one "day" of personal leave is a "notional day" consisting of one-tenth of the equivalent of an employee's ordinary hours of work in a two week period. It could also be calculated as 1/26 of an employee's ordinary hours of work in a year.
