19.01.2022 What is happening to the plan to build an incinerator for the municipal solid waste on 70 Ordish Road Dandenong: A way out! On 15 September 2020, the Victorian Civil Administrative Tribunal (VCAT) has decided to grant a company to build and operate an incinerator to burn municipal, industrial and commercial waste. VCAT decision was based on two main premises: First the EPA Work Approval and, Second, the failure of the Council of the City of Greater Dandenong to act time...ly and decisively. Bearing in mind that the permit application to build the incinerator was initially approved by the council 28 October 2019, to be rescinded in November 2019 and opposed in May 2020. Currently, the Council is launching a challenge to EPA Work Approval in VCAT. This challenge to EPA, if successful, and with the best possible outcome, it may lead to imposing more conditions on the already granted permit to build and operate the incinerator, based on numerous European examples. However, IT WILL MOST LIKELY NOT CANCEL THE PERMIT GRANTED BY VCAT. The only way to try to reverse the VCAT decision and to cancel permit to build and operate the incinerator is for the Council or anyone else to APPEAL TO THE SUPREME COURT, the only body with authority to overturn VCAT decision (order). Even the Appeal to the Supreme Court may have a small chance to succeed on technical grounds. A way out: In our opinion, the only effective weapon to succeed in cancelling the permit to build the incinerator is to propose a safe, eco-friendly alternative to municipal solid waste management MSW based on the following principles: Reducing waste, Effective Sorting at the Source, Composting, Recycling and Recovery and the use of eco-friendly technologies, e.g., Anaerobic Digestion and similar technologies, away from burning in all its forms and shapes. ACT has banned for five years the building of incinerators except for medical waste. 19 July 2018 In NSW the Independent Planning Commission rejected the application to build an incinerator by Eastern Creek Energy from Waste facility citing risk to public health among other reasons (SSD 6236) Away out: We strongly urge the Council of the City of Greater Dandenong to appeal to the Supreme Court ASAP before the 28 deadline expires and to include in its ground for appeal proposed eco-friendly MSW management alternative.
