24.01.2022 POOL DEADLINE APPROACHING FAST Don't put safety or your sales at stake - understand swimming pool laws image... Agents - be aware of your responsibilities when selling property or managing rented property with pools in NSW, including spa pools. 29 April is the deadline to comply with the additional requirements below. Requirements for sales agents To sell property with a swimming pool or spa pool, you must attach to the sales contract a valid copy of one of the following documents issued in the last 3 years: certificate of compliance relevant occupation certificate (together with evidence that the pool is registered), or certificate of non-compliance. If this is not done, the buyer may rescind the contract within 14 days of exchange, unless settlement has already occurred. These requirements do not apply to off-the-plan property or to properties in a strata or community scheme that has more than two lots. Be aware that a certificate of non-compliance transfers to the buyer the seller’s obligation to obtain a certificate of compliance. The buyer has 90 days from the date of settlement to rectify defects listed in the certificate and obtain a certificate of compliance. For further information on this, refer to the NSW Office of Local Government and NSW Land and Property Information (LPI) websites. Requirements for property managers When a tenancy agreement is entered into, the real estate agent (acting on behalf of the landlord) must give the tenant a copy of the valid certificate of compliance or occupation certificate for a property with a swimming pool or spa pool. Clause 40A of the residential tenancy agreement will be amended to provide that this obligation does not apply to properties in a strata or community scheme that has more than two lots. You can continue to use existing stock of standard form residential tenancy agreements with an addendum, which will be made available on our Forms page. The New Tenant Checklist will be updated from 29 April 2016. You can continue to use the current version of the checklist with an addendum, which will be available by that date on our website. How to obtain certification To arrange a compliance inspection, pool owners should contact their local council or find a private swimming pool certifier listed on the NSW Swimming Pool Register website. 17.01.2022 Excerpt taken from AIC website, regarding pest and building inspections. 2 April 2016 Prospective homebuyers in NSW will soon have greater access to discounted pre-purchase inspection reports, with reforms announced today by Minister for Innovation and Better Regulation Victor Dominello.... Mr Dominello said amendments to the Property Stock and Business Agents Regulation 2014 would help to reduce duplication of inspection reports, promoting peer-to-peer services that offer discounts to consumers. The changes will require real estate agents, when listing a property, to disclose all inspection reports taken out by a vendor or potential buyer. Agents will need to provide buyers who take out a sales contract with the names of companies which have recently completed inspections of the property. The register will also need to indicate which firms enable peer-to-peer sharing discounts. Building and pest inspection reports can cost anywhere from $200-$600 each, which represents a significant outlay for potential buyers, Mr Dominello said. This reform is a practical demonstration of the NSW Government’s commitment to embracing the collaborative economy. We want to encourage market disruptors whose business models rely on delivering better consumer experience and greater transparency, to flourish. This policy is the first of its kind in Australia and forms part of the NSW Government’s broader reform of the real estate sector. Having startups and disruptors compete in the property market and offer inspection reports is reflective of our 21st century economy. It also increases competition and reduces the price of these reports for potential buyers. Agents will be required to update their disclosures after each new report is completed. The new laws are due to come into effect before July.

05.01.2022 DEADLINE TO REGISTER POOLS & SPAS FAST APPROACHING!! The 29 October 2013 deadline for registering pools and spas is fast approaching. Under the new Swimming Pool Registration legislation any body of water that has a depth greater than 300mm and would normally be used for "human aquatic uses" - ie bathing, paddling, swimming must be registered prior to 29 October 2013. Once this date has passed you will be liable for a $220.00 fine.... 04.01.2022 Is it too early for New Years Resolutions? If not, mine is to update this page regularly in 2016. It has been a bumpy 2015 for me personally and a year of change for Southland. We will all be happy to see the New Year arrive after a well deserved rest over the Christmas break. Personally I would like to thank Courtney for the wonderful job she has done keeping everything together, especially whilst I was unable to be in the office during Dads periods in hospital. Thank... you also to Terry, Caroline, Sue & Leah who stepped in to help Court when I couldn't be here & to Sally for joining us at the end of the year to help get all of the end of year settlements organised so that I didn't have to sleep at the office lol. Thank you also to Madi for stepping in and hopefully getting somewhat of an understanding of what I do and what has fed her & her siblings for their entire lives ... she now knows that Mum doesn't just sit in an office all day doing nothing!!
