Fair Work Inspectors are in the area following anonymous reports and requests for assistance from West End employees, which suggest that some eateries may be breaking workplace laws. These reports allege that some West End workers are being underpaid their minimum hourly rates of pay under modern awards. Other reports suggest that employees are not receiving their lawful entitlements such as overtime and weekend penalty rates, and special allowances. Section 351 Fair Work Act 2009 provides concrete protections to all Australian workers in that workers cannot be discriminated against due to age, race, colour and religion amongst other things.... If such a dismissal is found to be lawful must it then extend to a ban on the sharing of all religious beliefs at work and outside of work irrespective of your chosen communication method? The Fair Work Act has req...uirements that employers may have to meet first, and you cant be dismissed for unlawful reasons. If employment ends, full-time and part-time employees may be entitled to redundancy pay and notice, and should be paid out other entitlements like outstanding wages and accrued annual leave. So make sure you check your entitlements. Casual employees dont usually get notice or redundancy pay. They should still get their unpaid wages. 07.01.2022 Addressing exploitation of vulnerable workers and non-compliance in the fast food, restaurant and caf sector are key priorities for us. Following our legal act...ion, the Courts handed down $124,416 in penalties against the operator of a chain of sushi outlets for deliberately underpaying migrant workers in Canberra. The chain underpaid 22 employees a total of $18,671 by not complying with the Restaurant Award, with affected workers not receiving the lawful minimum weekday rates, casual loadings and penalty rates for weekend and public holiday work. Leave entitlements were also underpaid and further breaches relating to making part-time agreements and record-keeping were discovered. Our inspectors discovered the underpayments when they audited over 40 sushi outlets across Canberra, South-East Queensland, the Hunter, Central Coast, Coffs Harbour and North Coast regions in NSW. We will continue to conduct audits across the fast food, restaurant and caf sector and hold employers accountable if they are not meeting their lawful obligations. 02.01.2022 On 8 April 2020, the Fair Work Commission made determinations varying 99 awards. Moving forward employees are entitled to: * 2 weeks of unpaid pandemic leave * the ability to take twice as much annual leave at half their normal pay (if their employer agrees). The schedule in each award applies from an employees first full pay period on or after 8 April 2020 until 30 June 2020. This end date can be extended by application to the Commission.
