02.01.2022 A message from the P&C with a reminder about social media posts. I spoke recently at a P&C meeting regarding the risks for members of the school community from making social media posts. Sadly this is not without precedent and in one high profile Queensland case a number of parents were successfully sued for defamation and some were bankrupted as a result. What perhaps made matters worse in that case, for some of the defendants, was the seeming injustice that the Principal ...involved sued parents with assets and the most to lose (while others seemed to suffer no repercussions). The truth is that there are, in these types of matters, no winners and even things rashly said in frustration or anger have potential to hurt and blow wildly out of proportion. The satisfaction, if any, from making these posts is short lived and the potential harm can last years after they are made. In Queensland the limitation period for defamation is generally 12 months, but can be as long as three years. Where even private texts or messages may be defamatory material, social media posts are not the best way to deal with school issues. It is not fair to the school or staff to be tried in the court of public opinion, particularly in closed Facebook groups where the subject of the post may not be aware or have right of response. Plus, they rarely if ever result in change or address even legitimate concerns. If you have a problem with a teacher or member of staff, I encourage you to take it up with the staff member involved. If you feel that you cannot do that please see the Deputy Principal or Principal. If your concern involves either the Deputy Principal or the Principal and you feel that you cannot take up the issue with them, please talk to the Department of Education. More information about how the Department resolves these issues can be obtained from the Department’s website (https://www.qld.gov.au//scho/information/contact/complaint). If you are a moderator or admin of a social media group or chat, you can in some jurisdictions be liable for defamatory posts even if you were not involved in posting them. If you do administer or moderator social media pages, check the site’s terms and conditions to understand your risk. Kane Jacobson President
