24.01.2022 The County Court decision to effectively close its trial division for the rest of the year means that once existing delays within the system are taken into account, someone charged with a crime today is unlikely to have their matter heard for three years. 17.01.2022 The Victorian State Budget has outlined a much-needed investment of $47.3 million to support legal assistance and access, and improvements to justice facilities. A new court facility in Wyndham and upgrades to the Sunshine court are especially important for local clients. Law Institute of Victoria (LIV) President Sam Pandya told Lawyers Weekly, $28.5 million will assist young and disadvantaged members of the community access legal services.

11.01.2022 Fears increase for Australian writer, Dr Yang Hengjun, who has been isolated and shackled in a Chinese jail in an attempt to push a confession to spying allegations. His Australian defence lawyer, Rob Stary, said Chinese security officials have already blocked all written messages, letters, books and documents from being passed to Dr Yang. There is a plain attempt to have Dr Yang be subjected to interrogation in complete isolation, cut off entirely from his loved ones and supporters. Another of Dr. Yang’s lawyers, Sarah Condon, stated: We also understand that during interrogations, which are now taking place on a daily basis, that Dr Yang’s wrists and feet are being shackled. He is being interrogated in a repetitive fashion. Despite being incarcerated now for many, many months, Dr Yang continues to be denied access to his lawyers."

03.01.2022 Have you found yourself in trouble, and possibly facing prosecution, and you don't know why? You might be scratching your head for good reason. We recently acted for a young man issued with a default notice, and had his car registration revoked until he proved his car was roadworthy. He rectified the issue, and VicRoads told him he was able to drive again. He was pulled over by the police soon after, and charged with driving while unregistered. We took action for our client, ...and a subpoena was issued upon VicRoads, revealing the default notice had been placed on their system after they'd given him the all-clear to drive. A simple administrative error had exposed our client to criminal prosecution. Happily, we discovered this error before our client had entered a plea and the charge was withdrawn. 03.01.2022 The pandemic has shrunk Victoria’s prison population to a two-year low, with a reduction in crime and increased approval of bail applications arresting a 20-year trend of putting more people behind bars. Defence lawyers and justice reformers say the figures should be a circuit breaker to review government policies such as tight bail laws, which drove the growth in prisoner numbers before the COVID-19 crisis. They also want corrections authorities to re-open Victorian jails ...to family visits for the first time since mid-March, when the nation’s prisons went into lockdown. Liberty Victoria co-chair Sam Norton said the prevention of a coronavirus outbreak in the prison system was a success. "We always knew they would take a really conservative approach in terms of visitors, knowing that COVID getting into prisons would just be a nightmare".
