20.01.2022 Building a New Home Can I access my Building Site? Building a new home is both an exciting and very stressful time, so it’s important to keep yourself informed of the progress of your build. For workplace, health and safety reasons, once a Builder starts on your home, they have possession and control of the building site. It is therefore important you do not attend on site, without the consent of the builder or you will likely be in breach of your building contract. ... So how do I gain access? 1. Contact your builder Communication is key throughout the whole building process. If you would like to inspect the progress of your home, contact the builder to make suitable arrangements. Keeping in mind that the safety of the site is the highest priority, so the builder may not be able to allow you access if short notice is given 2. Obtain permission in writing Check your contract, you may need permission in writing from your builder, prior to walking on site. However, even if your contract does not specifically require written permission, it is always best practice. If permission has been granted by phone, follow up with an email to the builder to confirm the arrangements you have made. 3. If the builder refuses Sometimes a builder may refuse to allow you on site, this may be for legitimate reasons, like it is unsafe on that particular day. However, a builder must allow reasonable access to a building site, under the Queensland Building and Construction Commission Act 1991 (‘the Act’). If the building contract you have specifically excludes you having access to the building site, such a clause it is in breach of the Act and will be void.
