24.01.2022 10 Year Maintenance Plans Can Strata Companies prepare their own. With The Strata Title Amendment Act 1985 soon to be proclaimed many Strata Companies are asking if it is ok for them to prepare their own 10 Year Maintenance Plans or do they need a suitable professional to prepare it for them. The Act certainly does not prohibit Strata Companies from preparing their own report and doing so would certainly save the Strata Company money but the question is should they prepare... it themselves. The plan needs to contain some methodology surrounding calculating life expectancy of items contained within the plan and replacement costs including escalation and I would suggest that a quantity surveyor, licensed builder or a combination of the two would be best placed to carry this out. Sure the Council of Owners could seek the advice from reputable companies in each field for estimated costs and perhaps even opinion on the remaining life span of the item but this is not where the biggest concern with self-preparation of the plan exists. When contemplating items for inclusion or exclusion form the report the decisions made here is where there is substantial risk. In preparing the plan themselves if the Council of Owners make a decision to exclude an item from the report and it turns out they were wrong, meaning the item ends up being replaced during the period of the report then that Council of Owners leave themselves and perhaps the Strata Company liable for potential litigation. My advice to Strata Companies is spend the money on having a suitable professional prepare your report! See more

17.01.2022 STRATA REFORMS - Time for your CoO to review. In our great state of Western Australia CoO is also an abbreviation used for the Council of Owners of a Strata Company. The amendments to the Strata Titles Act 1985 are significant and for those who dont deal in Strata legislation in WA there is far too much to get your head around in one go. ... Now is the time for Strata Company Council of Owners to evaluate their governance processes and make any necessary changes to ensure compliance. So the changes for the CoO. Council Members must: Act honestly, with loyalty and in good faith at all times Exercise a degree of care and diligence Not make improper use of their position to gain advantage or cause detriment to the strata company. Disclose in writing and direct or indirect pecuniary interest or conflict of interest. Here is what I am recommending the CoO need to do: Act now in reviewing your CoOs governance processes Make sure CoO meetings are well minuted When entering into a service agreement or contract be sure to minute the decision making process and the reasons behind the selection. Not just the decision itself. Service contracts should be put out to tender with adequate tender documentation that supports a fair and reasonable process designed at achieving the best outcome for the strata company. Avoid using trades or service providers related to CoO members or where a CoO member works for or owns in the business. When you do employ such a provider make sure that the relevant CoO member has correctly disclosed the conflict of interest and re frame from participating in the voting process. Minute this has occurred. With all decisions faced by the CoO subject the decision to the fairness test is this decision being made in the best interests of the Strata Company as a whole? Decisions made or funds being spent should not be for the sole benefit of CoO members or the minority of owners. Remember if the CoO are ever unsure it is always best to refer the decision to a general meeting of the Strata Company.

14.01.2022 Our most recent Strata Management Review: I would like to thank Mark Hay (both Luke and yourself) for all the hard work that you have put into transferring the Strata Management for 39 Tully Road from iFresh to Mark Hay. The level of service we now receive has put faith back into the COO that there are Strata Managers out there that do do a good job.... I feel over the last few months we have got the Strata into a really good position and we wouldnt have got there without the support of Mark Hay. As the world begins to shape and adapt to COVID-19, as we did post September 11 this legislation has the potential to become critical to the way Strata Companies in Western Australia conduc...t business in the future. The new legislation allows for a person including proxy to attend and vote at a meeting of the strata company by video link, telephone or similar means of remote communication in accordance with any requirements of the scheme. 03.01.2022 WA Strata Reforms bring Purchasers Power! The WA Strata Reforms will require Real Estate Agents, Settlement Agents and seller to change their approach when it comes to selling Strata Titled property in WA. The reforms deliver better buyer protection in the respect that they introduce a greater level of disclosure and provision of information and shift the need for this information to be provided prior to entering into a contract for sale. The reforms also introduce certai...n requirements at sale of a strata titled property when the seller is the scheme developer and one of the following applies: the strata titles scheme has not been registered the first annual general meeting has not been held the scheme developer owns 50% or more of the lots in the strata titles scheme the scheme developer owns lots with a total unit entitlement of 50% of the scheme aggregate It is anticipated that the reformed regulations will provide new prescribed forms for the provision of this information (currently Form 28 and Form 29). Some of the information that is currently provided in what is common referred to as a Section 43 certificate will need to be provided pre contract. Under the existing legislation a section 43 certificate isnt usually provided until post contract. What I perceive will result from this section of the reforms is more informed and educated buyers looking to purchase into a Strata Company that is well maintained, has sound financial management and is compliant with its statutory obligations. I support these changes and the transparency they bring. I also urge Strata Companies and their managers to ensure that the owners in their scheme will be able to compete in the market by ensuring they can showcase the very best in maintenance and financial planning.
