25.01.2022 Are you feeling stressed, tired and anxious about life and or legal matters? The skill of mindfulness aims to reduce worries, anxiety and distress by introducing some zen into your life. Mindfulness involves paying attention to the present moment with openness, curiosity and without judgement. - Smiling Mind.... Mindfullness aims to help you relax, help regulate your emotions, improve your concentration and productivity, develop a sense of empathy and connectedness, and improve your sleep and overall health. -Smiling Mind There are two forms of mindfulness: informal (directing your full attention to any given activity throughout the day i.e. being in the moment) and formal (techniques such as meditation). Our favourite app to practice mindfulness is @smilingmind. (We are in no way associated with smiling mind, we just love the app!) Are you going to practice mindfulness today? Pic: @travistyy

25.01.2022 There is something special about a grandparent & grandchild relationship. By the time our kids have kids, we have grown wiser, more patient and usually a tad richer! (Yay spoil the grandkids!) It is important that in the event of a divorce, children are given the opportunity to continue these relationships with their loved ones.... If you are experiencing isolation from your grandchildren, and you are not sure how to take the next step, contact one of our family law lawyers on 02 4295 3344 to arrange an appointment.

23.01.2022 As young people we tend to overlook the importance of having a will and think that wont happen to me.... but realiatically we sgould never say never! It is important to think about who you choose to inherit your estate as well as who you want to make decisions for your wellbeinv in circumstances where you no longer have the capacity to make them for yourself. We encourage you to not only think about the present but to think about the future. In one second your whole life can change and it can be a rewarding feeling knowing you have already made arrangemengs for your best interests in the future. If youd like to find out more dont hesitate to give us a call on 42953344

22.01.2022 Here’s some fun power of attorney facts: - Your power of attorney will only be in force while you are alive. - Most people consider a family member or close friend they trust to be their power of attorney. This person should understand your personal wishes. - Your chosen person is called an attorney. Your attorney can not be bankrupt. - You are pretty much giving someone total control over your assets and the ability to make legal decision on your behalf, so don’t take this... selection process lightly! Choose someone who is responsible with their own money and understands financial matters. Want more information, have a read of the legislation at: https://www.legislation.nsw.gov.au//ecfd4e6f-f/2003-53.pdf Or contact us on 02 4295 3344 and book an appointment with one of our solicitors. 22.01.2022 In NSW, an Enduring Guardian is someone you appoint to make lifestyle, health and medical decisions for you when you have lost the capacity to make these decisions for yourself. It is an important document and you should take careful consideration when choosing your enduring guardian, as this person should know and understand what you would want your life to be like if you have lost capacity. They can make decisions such as decide where you live, speak to doctors and decide what treatment you may need. The Enduring Guardian complements the other estate documents. Completing all three documents will make life easier for yourself and your family.

21.01.2022 Happy clients, happy lawyers.

21.01.2022 Instead of writing off 2020, let’s use it as an opportunity to grow. Today, each one of us is facing a challenge that we could never have anticipated. Some days are harder than others, and it’s important to try and focus on any positives, rather than revel in the negatives. The Black Dog Institute recommends the following 7 ways to help manage COVID-19 blues: 1. Recognise your feelings and rate it on a scale of 1-10. Speak to someone about your feelings. ... 2. Often stop and release any tension you are holding in your body. 3. Track your sleep, are you getting enough? What is the quality of your sleep? Develop ways to shut off your mind and improve your sleep. 4. Try not to focus on what if scenarios. Take notice of when you are thinking in a negative way and ask yourself is there a positive side to this situation? 5. Recognise your reactions to people and scenarios, are you behaving out of the ordinary/ snapping at people? Take a moment to reflect. 6. Have a check in buddy, someone you trust and feel comfortable talking to. 7. Exercise for at least an hour a day. Exercise is proven to reduce depression and anxiety by getting those positive endorphins flowing through the body. Remember we are all in this together. If you are feeling as though you aren’t coping with Covid-19, please seek professional help and call Lifeline on 13 11 14 or emergency. For more information, head over the the Black Dog Institution website. Pic: @smithhousephoto

20.01.2022 Let’s talk s60I certificates. These certificates are issued under s60I of the Family Law Act 1975 (Cth). Each party to a matter will receive a s60I certificate upon attending mediation, even if they resolve. It is important to make sure you retain your certificate after mediation, so that you can initiate proceedings if the matter is required to go to court due to breach of agreement by one party. The s60I certificate is valid for 12 months.... A s60I certificate can also be issued by a FDR practitioner for the following reasons: 1. the person did not attend FDR due to the refusal or failure of the other person or people to attend. 2. the person did not attend FDR because the practitioner did not consider it would be appropriate to conduct FDR. 3. the people attended FDR, conducted by the practitioner, and all people made a genuine effort to resolve the issue or issues in dispute. 4. the people attended FDR, conducted by the practitioner, but one or more of them did not make a genuine effort to resolve the issue or issues in dispute. 5. the people began FDR, but part way through the practitioner decided it was not appropriate to continue. A 60I certificate can also be issued where there are no contact details for a person and the other parties do not know how to find the person. Only accredited family dispute resolution practitioners can issue section 60I certificates. For more information, head to the familycourt.gov.au. Need help with your family law matter? 19.01.2022 We understand that separation can be stressful for everyone involved, especially children. With emotions running high, too often we see parents take the opportunity to use family law proceedings as a battlefield. This is detrimental to all parties involved. It is important to remember that When the court makes a parenting order, the Family Law Act 1975 (Cth) requires it to regard the best interests of the children as the most important consideration - Family Court of Aust...ralia The Family Law Act focuses on the rights of children and the responsibilities that each parent has towards their children, rather than on parental rights. - Family Court of Australia We help navigate you through the tough times to find a resolution that suits you and the children. 03.01.2022 It is a very common misconception that when a child turns 12 years of age, they can elect which parent they wish to reside with. This is a MYTH. These situations can be very hard for parents to deal with, and if proceedings are currently underway, the child may be allocated their own lawyer, called an "Independent Children's Lawyer" or "ICL". The ICL will attend court on behalf of the child, and after speaking with the child and any persons/professionals close to the child, consider all evidence and provide the court with an independent view as to the best interests of the child. If you've found yourself in this tricky situation, contact us on 02 4295 3344 to speak to one of our family lawyers. @ Shellharbour, New South Wales

02.01.2022 I want to see the budgies every second weekend! Pets are important members of the family. So what happens to pets when there is a separation? How does the Court decide which party will keep the pets? Well, in Australia there is currently no legislation to provide the courts with guidance regarding the living arrangements of family pets.... Pets are treated like any other property, like clothes or furniture, even though to you they are very special family members. If the issue of pet living arrangements arises, the court will make an order based on the evidence of both parties, usually in the form of affidavits. The following factors are frequently considered when deciding such matters: Who looks after the pets the most? Who covered financial expenses for the pet, such as vet visits and food? Who have the pet resided with since seperation? Whose name are they registered under (before separation)? Who does the animal have a strong emotional bond with?; and Are there are any children, and if so, who are the children primarily living with? We will be hugging our furry friends a little tighter after this post. Do you have a pet? Tag us in your favourite pet photo so we can lift the mood a little! Pic: @pinterest
