22.01.2022 COVID-19 situation for Temporary Skill Shortage visa (subclass 482) or Temporary Work (Skilled) visa (subclass 457). Temporary Skill Shortage and subclass 457 visa holders who have been stood down, but not laid off, will maintain a valid visa and businesses will have the opportunity to extend your visa as per normal arrangements. Businesses will be able to reduce your hours without you being in breach of your visa conditions or the business being in breach of their employer o...bligations. If you have been laid off and are currently unemployed, you should find another employer within 60 days or make arrangements to leave Australia, where this is possible. If you cannot return to your home country, you need to maintain a valid visa and follow Australia’s health advice where necessary. Holders of temporary work visas currently employed in critical sectors, like health, aged care or agriculture, may also be eligible for a COVID-19 pandemic Temporary Activity Visa (subclass 408) Australian Government Endorsed Agreement Event (AGEE) stream visa. Q. If your study in Australia is ending, and you are unable to depart Australia. You can apply for a Visitor visa (subclass 600). You need to do this before your Student visa expires. Q. If your course is ‘out of session’ You can work unlimited hours if your course is considered ‘out of session’. Courses are considered ‘out of session’ during scheduled course breaks or if a student has finished their course as scheduled. Q. If you are studying a masters by research or a doctorate course If you have commenced studying a masters by research or a doctorate course, you may work unlimited hours. Q. 21.01.2022 Australian Citizenship Bill Expires The proposed Australian Citizenship Legislation Amendment (Strengthening the Requirements for Australian Citizenship and Other Measures) Bill 2017 has been struck from parliamentary business due to expiration, effectively defeating the proposed amendments. The changes that were proposed to the period of residence, English language and other requirements for Australian citizenship will not proceed, as the Government's amendment Bill expired ...on 19 October 2017. The minister plans to reintroduce an amended version of the Bill, with a proposed introduction date of 1 July 2018. The English language test will be amended to a 'modest' level of English. Applications made before 20 April 2017 will be assessed against the eligibility criteria current at the time of application. Applications made before 1 July 2018 will be assessed against the eligibility criteria current at the time of application. Changes to the criteria will take effect from 1 July 2018, if the legislation is successfully passed. As such, until further notice, Citizenship application will continue to be assessed against the previous rules. This is an good news for those who want to lodge applications and are eligible. 19.01.2022 Long-stay Parent Visa - Open in April 2019 The Department of Immigration and Border Protection has announced today that the new five year sponsored parent visa, the Subclass 870 Parent (Temporary) Visa, will be open for application on 17 April 2019. Parents will be able to stay for up to five years at a time without departing and the Department has announced that up to 15,000 per year will be granted.... A three year visa is also available. NB: The introduction of this visa is still subject to introduction of supporting regulations The visa application charge is payable in two installments, with one payment at time of application and the remainder paid prior to visa grant. 08.01.2022 NSW Government - Justice of Peace services during COVID pandemic The NSW Government Communities & Justice Department has released guidelines to support Justices of the Peace (JP) during the COVID pandemic. Witnessing documents by audio visual link (AVL)... NSW JPs can now witness statutory declarations and affidavits in real time via audio visual link (AVL). This means that the JP has to witness the signing over a live audio visual link. A scanned copy of the signed document can then be sent to the witnessing JP. The JP should then sign the document as soon as practicable after witnessing the signing of the document. All tasks associated with witnessing can also be satisfied via AVL. The changes have been introduced under Section 17 of the Electronic Transactions Act and will be in effect until 26 September 2020, subject to any further regulation.
