22.01.2022 On 1 December 2019, the NSW Transport Authority implemented Mobile Phone Detection cameras which aim to reduce road fatalities by detecting and punishing illegal mobile phone use. The penalty for offending drivers is five demerit points and a $344 fine ($457 in a school zone). The penalty increases to 10 demerit points during double-demerit periods. 17.01.2022 Section 7 of the Bail Act 2013 (NSW) states that bail is authority to be at liberty of an offence. The Australian Legal System follows the presumption that a person is innocent until proven guilty, before a court. Once you have been detained for an alleged offence and bail has been refused by police officers pursuant to Section 9 of the Bail Act, your lawyer can assist you in applying for a court Bail application. Under Section 16 of the Act, the detained person must show... cause as to why their detention is not justified, and must prove that they do not present an unacceptable risk by their potential release. 10.01.2022 Do you have children over the age of 18 and still require Child Support? Section 66L of the Family Law Act (Cth) 1975 states that "A court must not make a child maintenance order in relation to a child who is 18 or over unless the court is satisfied that the provision of the maintenance is necessary: (a) to enable the child to complete his or her education; or (b) because of a mental or physical disability of the child".... This provision allows the Family Court to grant an order ensuring that child support needs to be paid for a dependent child over the age of 18 which needs assistance in relation to education or experiences mental or physical disability. However, it is fundamental to note that the Court will take into consideration many special factors to impose this Order including, the financial position of the parents, the ability of the child to generate an independent income and the necessity of imposing such an order. 01.01.2022 In response to the COVID-19 pandemic, the federal government has announced new rental waivers and deferrals for commercial tenants. Under this scheme, landlords are required to decrease leases in proportion to the reduction of the tenants business. This scheme is applicable to employees on JobSeeker payments or businesses which make a turnover of $50 million or less. 01.01.2022 During this difficult and distressing time amid the outbreak of COVID-19, the team at Takchi and Associates Solicitors advises everyone to take extra precaution and care when going about their daily routines. During this time, our office will be trading as usual, however, we will strive to take extra steps to ensure cleanliness and hygiene for both our clients and staff. The Public Health Act 2010 (NSW) allows government officials to enforce orders which attempt to control ...risks affecting the public. Pursuant to Section 7 of this act, all people which arrive in Australia or have had close contact with an infected person must self isolate for 14 days, individuals diagnosed with the virus must be placed in quarantine and public gatherings of more than 500 people are prohibited. Non compliance with these orders under Section 10 of this act, codifies a maximum penalty of 6 months in prison or a fine of 100 penalty units ($11,000). Additionally, the Supreme Court of New South Wales has advised that only parties to a case should be present in court and all jury trials have been temporarily suspended until further notice. Bail applications and civil trials have not been affected. It is advisable to seek medical assistance and advice should any symptoms such as a cough, sore throat, runny nose, difficultly breathing and fever start to cause you concern. It is recommended that should any of the following symptoms begin, you immediately isolate yourself and contact a medical professional such as your GP for assistance.
