25.01.2022 In 1885 the Victorian Government echoed others and passed a Licensing Act which took the first legislative aim at playing cards in pubs. Section 86 read: If an...y licensed victualler suffers or permits any person to play any unlawful game or sport in or upon his licensed premises or the appurtenances thereto he shall forfeit and pay for every such offence any sum not exceeding Twenty pounds. Youd think it wouldve been helpful if the legislation had an attached schedule or list of just what constituted an unlawful game but that wouldve made way too much sense. As over in the mother state that was left to the discretion and the degree of wowsery of the various magistrates. Immediately publicans were in trouble. In 1896: The licensee of the Zigzag Hotel was summoned by the licensing inspector for having allowed a game of euchre upon his licensed premises. There was no money or moneys worth on the game, but the inspector (Senior-sergeant Morrow) contended that cards was in itself an unlawful game, whether played for money or not. In support of this contention he quoted a ruling of the Full Court of Queens Bench. (The Presiding Magistrate) dismissed the case, without, however, giving his reasons. A few months later: George Christian, a licensed victualler at Tungamah, (was charged with allowing) four persons to play a game of euchre in his hotel There were no money stakes, but the two losers had to pay for drinks for themselves and the winner, the amount paid altogether being 2s For this offence Christian was summoned by the police, and the Licensing Court fined him 60s and 30s costs. Euchre and other games remained outlawed for pretty much 20 years until Senior-Sergeant MacHardy descended on the Terminus Hotel at Tocumwal in December 1908 and busted the publican, T.E. Campbell and three of his customers for playing euchre. In Goulburn Police Court the following January Campbell pleaded not guilty but his argument that it was just a friendly no-stakes game wasnt believed. He was convicted and fined 3 plus costs. One of his customers, though wasnt going so easily. Sydney Cottington was charged with playing a game of chance (euchre) on the same occasion. He pleaded not guilty, and was defended by Mr A. M. Betts. After hearing the evidence of Senior-Sergeant MacHardy, Mr Betts asked that the case be dismissed on two grounds that cards were not instruments of gaming in the meaning of section 4, sub-section 9, of the Police Offences Act. It was, he said, an entirely new provision. The second ground was that euchre was not a game of chance within the meaning of the Act, because skill came into it as much as chance. (Presiding Magistrate), Mr Adrian said he recognised the seriousness of the question raised, and adjourned the Court for some time, (saying) he took it that if any skill was introduced into a game it was no longer a game of chance. When the court was resumed, Magistrate Adrian ruled against Cottingtons first argument but upheld the second, that euchre was not a game of chance but involved skill and was thus not unlawful. The balance had changed: Whereas before that day in 1909 if a game had any degree of luck it was unlawful, from that decision on, if there was any degree of skill it was permitted. If you enjoy a hand of cards in the pub, thank the Terminus Hotel at Tocumwal because without them, youd not be permitted to order the dealer up or proudly show every point on the six and five! And thank em by having a drink in their beautiful bar, check out the old billiard room and the stained glass. Truly a pub with a story. 24.01.2022 AIRCRAFT ANNOUNCEMENT The mighty Grumman Avenger joins the massive Tocumwal Airshow lineup. The Grumman Avenger was the heaviest single-engine aircraft of W...WII and was first shown to the public at the factory on the afternoon of 7 December 1941 Pearl Harbour Day. The first action for the Avenger was the Battle of Midway on June 4 7 1942. Only six TBF-1 attended Midway but were credited with drawing the Japanese fighters away, so US dive bombers could attack the carriers. On August 24th, 1942, Avengers played a role in the East Solomons Saratoga/Enterprise sinking the carrier Ryujo. In November 1942 the Marine Corps and Navy sunk the Battleship Hiei at Guadalcanal with TBF Avengers. Another involvement for the avenger was the sinking of the Musashi and Yamato super battleships.
