24.01.2022 The Turner Freeman Medical Negligence team was saddened to read this news story about the death of a 19-year old American woman who spent 14 months in a coma after complications during breast augmentation surgery. Ms Emmalyn Nguyen went into cardiac arrest following the administration of anaesthetic for the purpose of her procedure. Allegedly, her treating doctor did not contact emergency services for five hours following the procedure and she suffered severe brain damage. Ms Nguyen spent 14 months in a coma before she ultimately passed away after she developed pneumonia and suffered a further cardiac arrest. 12.01.2022 Dr Leslie Blackstock, a general practitioner who held himself out as a cosmetic surgeon, has recently been found guilty of unsatisfactory professional conduct and professional misconduct following his treatment of 12 patients who underwent breast augmentation and labiaplasty surgeries. The NSW Civil and Administrative Tribunal made a number of findings including that Dr Blackstock failed to conduct appropriate pre-operative assessments, failed to obtain proper informed consen...t and inappropriately sat sedated patients up during surgery to obtain their consent. Dr Blackstock’s medical registration has been cancelled and he is unable to seek re-registration for a period of seven years. The NSW Health Care Complaints Commission is strongly urging anyone who had an ultrasound at the clinic, within that timeframe, to contact their GP for advice. 08.01.2022 The Turner Freeman medical negligence team watched the progression of the wrongful birth claim in Nouri v the Australian Capital Territory with interest from the Supreme Court to the Court of Appeal of the Australian Capital Territory and special leave (permission) to appeal the decision to the High Court of Australia which was recently refused. Wrongful birth claims relate to negligent management of pregnancies which would have been terminated if the parents had known of the... risks of the child having impairments. Various tests including amniocentesis are available to determine the risk of the fetus having chromosomal abnormalities. When a child is born with severe impairments in these circumstances, a claim can no longer be brought by or for the child. These cases are referred to as "wrongful life" cases. The only legal option for the parents is to pursue a wrongful birth claim and obtain compensation for different types of damages if they are successful in proving negligence. Health providers are required to have professional indemnity insurance and if plaintiffs in these cases are successful, the insurer will pay compensation which they can use for the benefit of their child. Courts decide how the law should be interpreted and applied to each case. The decisions of these cases are often followed by other courts. There is yet to be clear authority from the Court of Appeal or High Court of Australia in relation to how damages should be assessed in wrongful birth claims, including whether parents should be compensated for the costs associated with the child's impairments until the child is 18 years of age, or until the end of their life expectancy.

03.01.2022 With Silicosis disease cases rapidly growing throughout Australia, Doctors at Brisbane's Prince Charles Hospital say they have found a potential cure for the deadly disease. The treatment, adapted in Brisbane, involves washing the lungs out with salt water, which is a ground breaking technique proven successful when treating other lung diseases. As part of the $500,000 study, they have begun trialling the treatment on six patients with early stage silicosis where they have successfully removed silica crystals from the lungs of patients. 03.01.2022 The TCI class action is brought by Turner Freeman Lawyers on behalf of injured women who had breast augmentation surgery at The Cosmetic Institute (TCI). The defendants being sued include TCI, Dr Eddy Dona, plastic surgeon and surgical director of TCI between 2012 and 2016 and the TCI Surgeons. The insurers for TCI and Dr Eddy Dona have refused to agree to indemnify them pursuant to their insurance policies and therefore, currently, will not pay compensation in the class act...ion if TCI and Dr Dona are found to be liable. To protect the interests of the injured women, Turner Freeman has been forced to file a Court application seeking to join these insurers to the proceedings. The NSW Supreme Court will hear this application on 10 December 2020. If the Court allows these insurers to be joined, they will also become defendants in the class action. If the class action does not settle, the Court will decide if the defendants are responsible and if so, whether their insurers will need to indemnify them and pay compensation on their behalf.
