25.01.2022 INVITATION TO JOIN TAAWA COMMITTEE TERM 2016-17 Dear Khun Pen, I am writing to you on behalf of Khun Saowarak Srisukkho, about recent events in respect of the Thai-Australian Association of WA. (Inc.) ... Khun Saowarak feels that for a variety of reasons, the immediate past Committee did not enjoy a productive year. This was most evident at the recent AGM which proved unsatisfactory for the vast majority of all those who attended. She also believes that most members hope that within the Thai community, unity be restored quickly. This is based on her view that most people prefer harmony to dissent, and are always inclined to cooperation rather than conflict. In the spirit of harmony, she is hoping that you will join with her to consider the prospect of restoring unity to the Thai community. As a gesture of goodwill, she would invite you to accept the position of Vice President for 2016 -17. In addition, she is also proposing that one of your recent candidates for election, be invited to join the present Committee. She makes this gesture in the sincere belief that is in the best interests of the whole community. As there are aspects of this matter that would require further consideration, she would look forward to discussing this matter with you in more detail. 09.01.2022 Important notice for members of the Thai-Australian Association of Western Australia (TAAWA) A dispute over the outcome of the election for the 2016-17 Committee of Management was subject to mediation this week. The outcome of the mediation includes that an application will be made to the State Administrative Tribunal to determine:... 1. Whether nominations for Committee of Management positions received by the TAAWA Secretary after 21 October 2016 were valid; and 2. Whether the 27 November 2016 Annual General Meeting resulted in the valid election of the 2016/2017 Committee of Management. As a result of mediation the parties have agreed not to make any disparaging comments relating to the election outcome and about each other, including on social media, and ask that other TAAWA members and associates refrain from doing so as well. The proposers of a special general meeting called to raise concerns about the election will be asked not to proceed with that meeting now that the matter is being referred to the State Administrative Tribunal. 07.01.2022 RETURNING OFFICERS REPORT THAI AUSTRALIA ASSOCIATION OF WA 2016 AGM (in English-Thai translation part 2) After receiving a query from the outgoing President... on 26 November 2016 in relation to the validity of late nominations, citing rule 10.4 of the TAAWA Constitution, I reviewed the closing date for nominations. . I have determined the closing date for nominations to remain as 5pm, 21 October 2016 for the following reasons. 1. The intended date of the AGM was 30 October 2016 with close of nominations being 21 October 2016 as decided by the TAAWA Committee. This date was in fact nine (9) days before the AGM, as such the Committee had decided to act outside of their constitution creating a precedent. 2. The postponement of the 30 October 2016 AGM to 27 November was for the purposes of honouring the Thai King and to respect of his passing. Upon review of committee minutes, I found that no consideration for postponement was given to postponing the process of election of Committee members 3. The TAAWA Committee resolved to postpone the AGM. There was no resolution to postpone the closing dates of membership and or nominations 4. The notice to all members of the TAAWA regarding the AGM and nominations advised the closing date of 21 October 2016. To retrospectively amend that date would disadvantage the vast majority of the TAAWA membership. - 5. All nominations received after the closing date were completed on a standard form that clearly stated that nominations were due by Friday 21st October, 2016. In relation to the validity of the late nominations, I also found that a number were not compliant to rules 7.3 and 10.4 at the time of due one or both signatories were not financial members. . . The following is a summary of those nominations: President: Phanpen Limpus, nominated by Guy Sutton-Mattocks, seconded by Kanokgan Chokchaiaphiwat. Dated 03 November 2016. Kanokgan Chokchaiaphiwat not a financial member. Renewal date 16 November 2016. - Vice President: Wannipha Buakaew, nominated by Kanokgan Chokchaiaphiwat, seconded by Angsana Gomes. 02.01.2022 Hi all, Last Sunday was AGM day and it was indeed a very dramatic day. For everyone who attended, the election of a new committee was the most awaited item. I would like to explain what actually happened on the day. The AGM was organised by the 2015 16 Committee They made all the decisions about how the AGM would be run, and made all the arrangements, because this is the job of the Committee. Though it might come as a surprise to some, I had no part in organising anything,... as I was not a part of that Committee. I attended with my team as a candidate for election, hoping for members to vote for Team Thailand, attending like everyone else who came along. The meeting proceeded but unfortunately there was no election! Why was this and why was Team Thailand appointed as the new committee? Its important to say immediately; rules apply to organisations such as TAAWA, such as how they conduct meetings and so on. Rules are there to be followed. Although some think otherwise, I can assure you I dont make the rules they are made by a government department. We submitted nomination forms for Team Thailand by the deadline printed on the form, just as it was stated. Those who were disappointed by this, including those who were unhappy with the conduct of the whole of the AGM, perhaps should ask the past President and Committee to explain. Common sense tells us, you cant have a set of rules (or deadlines), for one team and different set of rules for the other. Unfortunately, because the final decision made did not please some, they became very loud and agitated and abusive towards the Chairman and Returning Officer. Only when the police arrived to control the crowd was the meeting finalised. .I was saddened to see both the Returning Officer and the Chairman, who gave their time freely, to do a job as guests of TAAWA, treated so badly by some in the audience. It was neither gracious nor dignified behaviour. While we may disagree, it was disturbing for others to see such hostility displayed. . As the new President of TAAWA, I would like to welcome all our members and friends. If you happen to hear something different from what I have conveyed, please share it with us.
