24.01.2022 Summertime in Oz! As an island continent, summers at the beach are part of Australia’s national identity. It is integral to our way of life and as summer beckons we are digging out our swimsuits and heading to our summer playground to indulge our aquatic lifestyle. With most of our urban development concentrated near the coast, every weekend during the summer sees a mass exodus to cavort in the turquoise water, ride the waves, enjoy a family picnic or simply relax on the gol...den sand. The image is idyllic but there are some fundamental safety precautions to observe. Foremost, is sun safety. Before venturing into the sunshine, SLIP on a shirt, SLOP on some sunscreen at least fifteen minutes before going out into the sun and SLAP on a hat. Sunglasses are advised, also and drink plenty of water. Avoid being in the sun between 10.00 a.m. and 4.00 p.m. Even on overcast days, you can burn really quickly and Australia has the dubious reputation of having the highest incidence of melanoma in the world. Only swim at a beach patrolled by lifeguards. Never swim alone and ALWAYS swim between the red and yellow flags. Also, be aware that, while the water and the waves are enticing, they can be deceptive. Undercurrents and rips can be treacherous - particularly so early in the season. Rips occur in deeper water so it is usually darker than the white water of the waves rolling into the beach and because the water is deeper, there will be fewer breaking waves, giving the appearance that the water is safe. The red and yellow flags mark the safe swimming area but if you are unsure ask the lifeguards. Our iconic beaches welcome you but before you join the locals do some research. 19.01.2022 With Christmas and New Year festivities over, Australians are gearing up to celebrate their national day. January 26 is Australia Day the anniversary of the arrival of the ‘First Fleet’ in Sydney Cove in 1788. Led by Captain Arthur Phillip, the First Fleet arrived from Britain to establish a penal colony in the Great South Land. Because of the disruption European settlement brought to Indigenous Australians, many representatives from that community don’t share the euphoria ...of the event. However, many local councils are inclusive of the Indigenous perspective in their Australia Day programs. In Sydney, a dramatic enactment begins with the lighting of an honorary fire at the Sydney Opera House. This is transferred to the Tribal Warrior, an Aboriginal vessel, which is then greeted by bark canoes beneath the Harbour Bridge, where the Aboriginal and Australian flags are raised in a symbol of unity to pay tribute to the nation’s proud and ancient Indigenous history. The day is gazetted as a public holiday and many Australians display their national pride by flying the Australian flag and wearing T shirts, caps and other articles of clothing replicating the flag. In the height of summer, celebrations are held outdoors, with backyard barbecues and beach gatherings always popular. Communities are brought together through community breakfasts and other events held in local parks. For many, the highlight of the day is the spectacular fireworks display hosted by capital cities. 09.01.2022 457 visas will be scrapped in March 2018 They will be replaced with two new visas to be known as the Temporary Skill Shortage (TSS) visas There will be two streams known as the short term stream (two year visa) and the medium term stream (four year visa)... Almost all applications will need to be Labour Market Tested The list of occupations that are eligible to be nominated will be drastically reduced to come into effect on 19 April 2017 (tomorrow) and apply to all 457 applications lodged from that date as well as to the new visas coming into effect in March 2018 Visa applicants will need at least two years relevant work experience Only holders of the medium term visa will be eligible to apply for permanent residence after three years (currently two years) Higher English requirements Applicants will need to provide police checks (currently not required for most 457 applications) Concessions for regional employers For those Applicants that have applications lodged but not yet approved, if the Occupation has been removed the application will need to be withdrawn. 08.01.2022 The recently released report by the Productivity Commission into the Migrant Intake into Australia has recommended that the decision to tax these visa holders from 2017 be closely examined/monitored. In writing this report early in 2016, they were basing their recommendation on the advice that the changes were to take effect from July 2016 and unaware of the decision to defer these changes until early 2017* announced during the election campaign. Their recommendations are th...at: The Australian Government should monitor the effects and assess the costs and benefits of changes to the: Tax status of working holiday makers (to take effect from (1 July 2016 deferred see above*) eligibility of voluntary work as an input to the 88 days of employment needed to get a year's extension to a working holiday visa. If the community-wide costs are found to outweigh the benefits, the Government should revisit these changes with a view to varying the conditions of the changes or rescinding them. There has been a great deal of criticism for this proposal, particularly from employers in Regional Australia who rely on these visa holders to fill vacancies and I can see how this recommendation from the Productivity Commission was framed in these terms. Working holidaymakers, in the main are here to look around our Country and take on employment as a means of financing their stay; many have taken time from their studies and have limited financial resources, so to tax their limited earnings only acts to limit their numbers. There are other Countries who will benefit from this market. In this instance I think the recommendation is very appropriate, however there are many more that will bring a shudder to other sectors of the Australian community, and I will elaborate on them in another articles. 06.01.2022 457 VISA PROGRAM TO END The Prime Minister and the Immigration Minister, today announced an end to the existing 457 visa stream. It will be replaced by a new stream consisting of a two and four year visa with new conditions and available for some occupations once an employer can demonstrate that they have been unable to find any Australian available to fill the position. There is little other detail available at this time and there will need to be a transitional period for th...e changes. We do know that existing 457 visa holders will not be affected. 06.01.2022 THE BIG RACE With the excesses of Christmas over, Australians are turning their attention to long, leisurely holidays at the beach and the euphoria of major international sporting events, starting with the iconic Sydney to Hobart yacht race. Considered to be one of the most gruelling ocean yacht races in the world, the 630 nautical mile (1170 km) Sydney-Hobart, which attracts a fleet of international competitors, sets sail on Sydney Harbour at 1.00 p.m. on Boxing Day. The sta...rt of the race is a colourful spectacle as a flotilla of small craft fills the harbour to farewell the fleet on its way and throngs of Sydney siders jostle for vantage points along the banks, while helicopters buzz overhead to capture footage of the spectacle for world-wide media organisations. From the spectacular start, the fleet sails through the harbour heads out into the Tasman Sea for the first of three legs of the event. The first leg takes them down the south-east coast of mainland Australia, where those craft sailing close enough to the coast may catch glimpses of sparkling beaches, coastal townships and fishing villages. As they leave the mainland behind, the yachts enter the second leg of the often-treacherous Bass Strait, separating Tasmania from the mainland. The third leg takes the fleet down the east coast of Tasmania, past coastal settlements with rugged mountains as a backdrop. As they approach Tasman Island, the coastline becomes inhospitable, with massive cliffs, often shrouded in fog. At Tasman Island, the fleet turns right to sail up the Derwent River to the historic port city of Hobart. Winds along the Derwent are unpredictable and in a close finish, the race can be won or lost in this final stretch. With a spectacle to rival the start of the race in Sydney, the people of Hobart crowd the foreshores of Sullivans Cove to cheer the yachts to the finish line and meet the weary crews with typical Tasmanian hospitality. Many of the maxi yachts complete this challenging event well inside two days, with the race record, set by Wild Oats in 2012, being 42 hours and 23 minutes. 06.01.2022 COST OF OBTAINING A VISA As anyone who has sought the advice of professionals to carry out the task of obtaining a visa will know, the cost can vary significantly between various agents or agencies. Having said that, any potential client should ensure that the deal with a person who is a Registered Australian Migration Agent, their registration can be checked by going to https://www.mara.gov.au/search-the-register-of-migration-a/. You can also check if any disciplinary actio...n has been taken against them. What never ceases to amaze me from week to week in our migration practice is the amount of potential clients who advise us that they have been quoted or have previously paid a professional amount which is anywhere between 3 to 10 times our fee. Our professional fee is separate from any Department of Immigration and Border Protection (DIBP) cost or third party fee, and we make sure that the person making an enquiry is aware of this difference when discussing the issue. In my view, there is no justification for overcharging in this field. The DIBP fee is substantial for many visa categories without paying a professional fee, which is way over the top. A guide to some common agent fees can be found on The Migration Agents Registration Authority website at https://www.mara.gov.au//working-with-your-age/agent-fees/. Of course, agent fees in Australia are subject to GST. However if overseas clients engage an agent in Australia, they are not liable for say VAT or GST.
