23.01.2022 STATION BEACH TRIAL - DAY 3 You don’t say ‘I’m going for a walk with the dog’, you say ‘I’m going to walk the dog’. So says Senior Counsel for the Applicant, ...Neil Williams SC. The point he was making (in his words) is that it’s not a people-focused activity, or put another way it’s all about the dog. And this is how silly things became today. According to the Applicant, or his SC, owning a dog does nothing for a person, or a family. It’s just a whole bunch of work that includes walking the dog. This moment provided a clear insight into the lack of empathy held by those bringing this Application. There is no attempt to appreciate that families all over Northern Beaches count their dog as a family member, entitled to be part of outdoor recreation together, and creation of the memories that flow from enjoying access to quality space. Mr Williams spent most of the first hour today taking His Honour to case law in his efforts to land on an interpretation of the word activity that suited his argument. Submissions were then made on concepts such as dedication, "intensification and enlargement. According to the Applicant, revocation of a dog prohibition creates a dedicated use, that is, a Dog Park. This makes you wonder how it is that happily-shared off-leash places like Clontarf Reserve, Centennial Park, Queens Park, Sydney Park, Blackwattle Bay Park etc manage to host all the mixed-use activity we see like weddings, ethnic celebrations, family picnics, play equipment, bike paths, ball games, BBQ’s in addition to off-leash fun. The argument about intensification cited an increased number of dogs on Station Beach this year. Well who would have thunk it? Maybe the new sign had a role in this? And then there’s COVID. Of course, an SC pulling down $12k/day just to turn up might not know a great deal about stress. But those who have lost family and livelihood, or are getting by on greatly reduced income, know quite a bit about stress, and that one of nature’s greatest tonics is a walk on the beach with the dog. Laughably, the argument about enlargement included reference to dogs being permitted on the beach for 18.5 hours a day. Of course, by this, the Applicant is suggesting people would choose to walk their dogs on Station Beach in the dead of night. With all of the muddying of the water, and claims that walking the dog is an activity or use for which development consent is required, things became greatly complicated today. His Honour was at one stage contemplating the view that the December decision (on-leash) granted more than the August decision (off-leash), by virtue of the fact that no western boundary had been defined with the December decision. Of course, the practical boundary to the west is that line which is reached by the length of the leash, as all that was dealt with in December was an on-leash consideration. Council at no time, in either decision, is abandoning the DPI-Fisheries call to keep off the seagrass at those times of dead low tide. And then there is also the matter of no prohibition of dogs in the waterway itself. Though not clear to the Court, a dog can approach Station Beach from the seawards direction without encountering any fetter (except perhaps a shark), until it reaches the beach, where it is caught by the no dogs on beaches policy. Today was total madness, to outsiders looking in. At the close today, Mr Galasso SC for First Respondent (Council) was coming to the end of his submissions. During this period, His Honour was signalling a possible outcome whereby he might have to make a declaration that differed for the area above Mean High Water Mark (MHWM), and for the area below MHWM. The Applicant is seeking an injunction to stop families with dogs having access to the beach, and is calling for the decisions of Council (August and December) to be set aside. More tomorrow

10.01.2022 WARNING!!! DO NOT GIVE THESE SO-CALLED "TREATS" TO YOUR DOGS!!! THEY CAN POTENTIALLY KILL THEM!! Just a little warning regarding the Xmas treats many stor...es are now starting to stock for dogs at Xmas. Many of these so called treats end up with the dog "enjoying" some time in a veterinary surgery over Christmas. The vast majority of these rawhide products and treats come from China. The chews are made from cattle or horse hides and their journey starts with the hides being soaked in a toxic sodium sulphide to remove the hair and fat. More chemicals are used in order to split the hide into layers which is then washed with hydrogen peroxide to give the white "pure" look and remove the rancid smell. Now comes the pretty festive colours and the glue to form cute shapes. On testing, these chews have shown traces of arsenic, mercury, chromium and formaldehyde. If that wasn't bad enough, they regularly cause intestinal blockages, poisoning from chemical residue and choking. The chews go slippery when wet and are near impossible to get hold of to save a choking dog. Leave them in the shop where they belong or if some well meaning person buys them for your dog put them safely away for later, then dispatch in the bin! Please be safe with your dogs!
