Thanks also to my amazing and wonderful staff Sally, Nancy and Tanneil for being so creative and supportive, and committed to continue delivering quality service to our clients! We will be able to continue assisting our clients with their estate planning, estate administration and estate litigation notwithstanding the unfolding COVID-19 disaster. The issues of legal costs in disputed matters is always difficult, and it is important to know that: "The Court has an absolute and unfettered discretion to award costs. 12.01.2022 We are not regretting our decision to stay home where we can, especially after reading articles like this one. But we are still WORKING!!! We are talking to our clients, we are drafting wills and powers of attorney. We are transferring land to give effect to complex restructuring for estate planning purposes. We are assisting with superannuation claims and applications for grants of probate.... We are resolving estate disputes. 07.01.2022 At long last we finally have regulations that permit execution of estate planning documents by video link. Hooray! These regulations are effective to 31 December, and would be used in rare circumstances, but they do mean that wills and powers of attorney may be signed "remotely", thus avoiding personal contact during the times of pandemic. We are proud to have been involved in advising government about appropriate legislation.

We are big fans of mediation as a way of resolving these issues, although it is not always successful, as in this case. 02.01.2022 Heres a memory from 2012 when an article I wrote predicting that the courts power to authorise wills for mentally incapacitated people would be used to achieve more sophisticated wills than those that had been made under the newish (then) statutory innovation was published in this journal. We are passionate about creative estate planning that actually makes a difference, rather than churning out tired and non-beneficial outcomes. We think that life (and death) is more important than that!
