17.01.2022 A MOMENTOUS Land Court ruling effectively allowing Torres Strait Islanders to own their homes for the first time could pave the way for other indigenous communities to achieve the same. The decision, handed down on Monday, clears the way for more than 100 homes to be transferred to Katter leases, meaning the inhabitants own the properties in perpetuity. The court also found where a lease entitlement was valid and no other obstacle existed, the lease would extinguish native ...title over the site, granting exclusive possession to the entitlement holder forever. Torres Strait Island Regional Council mayor Fred Gela said the ruling was bitter sweet, with many islanders who had argued for the right to own their homes now dead. People have waited more than 30 years for this, Cr Gela said. Sadly a lot of our applicants for these leases, some have passed away, so their next of kin will be realising and experiencing ... what their parents applied for. It is not only historic for the people of the Torres Strait, it sets a precedent that now can be experienced by Aboriginal people throughout Queensland. Cr Gela said it was now up to State Development Minister Anthony Lynham to grant the valid lease entitlements. A Natural Resources and Mines department spokesman said the Government was carefully considering its position following the Land Court’s decision, and was committed to land title that supports economic development and jobs in indigenous communities.
