25.01.2022 If you are not guilty of an indictable offence (but the Prosecution are intent on trying to convict you) you will be put on trial in front of a jury. At trial, you are entitled to defend yourself by challenging the evidence of the Crowns witnesses through a process called cross examination. If you are representing yourself, there are certain witnesses that you are not allowed to cross examine and there are rules that have to be obeyed when asking questions of the witnesses you can. If you are facing trial you should not do it alone, experienced representation can and does make a lot of difference. Get in touch if you or a loved one is going to trial in the District or Supreme Courts.

20.01.2022 I regularly appear in the Holland Park Magistrates Court. The police cells next door are some of the busiest in the Brisbane Metro area and if a friend or loved one finds themselves inside them, you should get in touch.

14.01.2022 The Beenleigh courthouse is one of the busiest in Queensland. It is home to the Beenleigh Magistrates Court the, the Beenleigh Domestic Violence Court and Beenleigh District and Childrens Courts. The hard working court support volunteers and duty lawyers offer a great service but it can often be a long wait to see them and their assistance is, necessarily, limited. If you have been charged with an offence you should strongly consider seeing a lawyer before your first court date so that you can go in well prepared and potentially save yourself some significant time on the day. I regularly appear in all the Beenleigh Courts and Im always happy to discuss a clients situation on a cost and obligation free basis - reach out if you would like to chat about an upcoming court date.

13.01.2022 One of the functions of a Magistrates Court is to conduct committal proceedings to bring serious charges, called indictable offences up to a higher court (either the District or Supreme Courts). A person who is charged with an indictable offence has a range of options open to them in relation to their committal proceeding (including asking to cross examine witnesses to challenge the bona fides of the Crown case right from the start). 12.01.2022 When police arrest and charge a person with a criminal offence they are required by law (in most circumstances) to release them on Bail rather than keep them locked up (unless they are satisfied of certain risks that only continuing custody can manage). The decision to grant, or deny, bail rests with the Officer in Charge of the Watchhouse first - and then a Magistrate if the Police refuse bail. Trying to convince a Magistrate to grant you bail while the Police Service argue you should stay in custody is a tough ask and you shouldnt do it alone. If your loved one is in Police custody, get in touch ASAP and well talk about how I can help.
