The program will use technology developed by Conrad Law and operated by volunteer JCU law students under legal supervision, to provide free legal assistance that may not otherwise be affordable or accessible. The assistance could potentially address any legal issue arising from being affected by flooding, not just assistance with insurance claims. The program is also designed to provide valuable work experience for law students nearing the end of their studies. Conrad Law and the JCU Law School are holding a program launch and information session at the JCU city campus, this coming Monday afternoon 25th March, 2019 at 5.30pm. light refreshments will be provided. While our ground floor continues to undergo extensive reconstruction from the devastating monsoon, we are... happy to announce that the Townsville RSL is scheduled to reopen on Saturday April 20 from 10am. Lavaracks Restaurant will be open 7 days a week with 2 delicious menus, one for lunch (11:30am - 2pm) and another for dinner (5:30pm - 9:00pm), giving our members and guests plenty of dining options. Outside these times, coffee, tea & a limited range of snacks will be available. Our functions room will be transformed into our new bar area with plenty of tables and chairs to relax, enjoy a cold drink and catch the big games on our 2 x 75" tv & digital projector. Our gaming lounge will also be located in the functions room with plenty of options including dragon link, lightning links machines. The Palm Lounge will also be transformed and become the home of our new TAB with TV's to keep upto date with the odds as well as plenty of seating to grab a coffee and cake from Lavaracks and catch up with your friends. 19.01.2022 TOWNSVILLE CLAIM TIP: What about your contents? By now, you have probably realised just how many contents items have been affected by this flood event. We rarel...y think about the amount of contents items we own on those rare occasions that we do consider our contents, we usually think about electronics, major furniture items, and maybe a few of our more expensive purchases. The reality is that the vast number of small, inexpensive items that quickly add up. Books, CD/DVDs, clothing, bed-linen, the list is endless. And it is not until you start to make a list that you realise just how valuable your contents items are. The first thing I want to address is that many of you will soon discover that you have under-insured your contents. I have a couple of tips for you: 1. In respect to this claim, carefully read your policy PDS. Most policies contain an additional benefits section, and often, this will extend your sum insured by 10% or 20% in the event of a catastrophe. Don’t wait for your insurer or assessor to tell you about this benefit, discover it for yourself and ask the question. 2. On the above point, some policies also cover additional costs such as removal of debris, over and above the sum insured. Just make sure you read right through the additional benefits section of your policy to see if you are entitled to more than just your sum insured. 3. Carpets, curtains and blinds are all considered contents they are NOT part of your building. Many people don’t realise this. Just be aware, if you don’t have contents insurance, you won’t be covered for damage to carpet, curtains or blinds. 4. As a rule, if you are a family without anything special in respect to contents items (so, you don’t buy designer label goods, top of the range electronics etc), then you likely have $100,000 or so in contents going by replacement cost. If you are insured for $30,000 or $50,000 I can guarantee you, even without seeing your home, that you are woefully underinsured. Now, this is totally up to you you may be happy with $30,000 in the event of a flood or a fire. But in my experience, most people have no idea how under-insured they were until they lose it all. Whilst it might not help you right now in this event, please consider increasing your sum insured for the future. The second thing I want to address is the issue of proof of loss. Some assessors will tell you that you MUST supply receipts, invoices etc. There is no policy PDS that I am aware of that specifically states that you need receipts. Most policies will only state that you have to show evidence of your loss. This is a very subjective standard, and means something different to each person. A few tips: 1. If you still have the items around, make sure you have photographic evidence. The more photographic evidence you can produce, the less questions your insurer is likely to ask in regard to proving your loss. 2. When you take photos, photograph the whole item, then a close-up of the damaged areas of the item (if totally inundated, just a close-up that shows the mud/water damage more clearly), and then a third photo that clarifies more about the item. For instance, a TV you would photograph the serial number plate or similar. Or the warranty book. If it is a lounge, there should be a patch showing type, make, seller etc. If you do this for all major items, again it will reduce the questions they put back to you. 3. If you don’t have photos or the item was washed away, you may need to come up with some other evidence. A receipt, details of where you bought the item, or even something like a Facebook photo that might show the item at the house sometime in the past. Be creative, there is usually some way you can prove the item existed. If it was a gift, ask for a statement or email from the person that bought it for you. Or get statements from friends or family who know you had the item to verify what you are saying. 4. Ultimately, if an assessor or insurer tries to exclude an item because they do not think you have proven your loss, put it back on them and ask them to provide you that decision in writing, along with the specific section of the policy that they are using to deny that item. Don’t forget, it is up to an insurer to justify that they can reduce or exclude an item from the claim. It is not good enough for them to merely say no without proper justification. Hold them to it. Some insurers will try to replace your items with a cheaper brand, or will even tell you that they will only give you a gift card to a specific retailer usually one of the cheaper ones, that has given them a reduced price that you have to purchase the replacement item from. Whilst some policies do give the insurer the opportunity to decide how they will settle the claim, they also have to replace items like for like. This means if the exact same model is available (even if there is a cheaper alternative), you can insist on them providing you with the same item you had. If you have had a total loss, I recommend that you insist on your insurer paying the entire contents sum insured out. You would be surprised how often they don’t do that. They will still ask you to provide them with a full list of items, and if your list does not total your sum insured, you will only receive money for the amount that is on your list. Make sure you don’t under-value your items replacement clothing items, for instance, usually exceed $5,000 per adult in a family, once you factor in everything you own. Don’t just think through the major items and do an incomplete list. Include EVERYTHING, and fully value everything at what it would cost you to replace that item with its new equivalent. Often, insurers want to get the contents claims out of the way so they can focus on the rebuilding process. This is appropriate, because you will likely have lost most of your worldly goods, and need to replace them ASAP. You can also request an emergency payment of $5,000 or $10,000 towards your contents if you are experiencing difficulty. Finally, don’t take any of the above as a reason to be difficult with your assessor or insurer, if it is not necessary. I want to arm you with knowledge so you can stand up for yourselves in the event your insurer or assessor doesn’t do the right thing, but in many cases, you should be able to negotiate a reasonable contents settlement much quicker than the building claim. The most important thing is that the more information you willingly provide in the first instance, the more likelihood your contents claim will run smoothly. But if not, don’t allow yourself to be bullied into accepting less than you are entitled to. We have attached a Contents Inventory Spreadsheet to our Facebook page that you can freely download and use as a starting point, if you need to lodge a contents claim. 18.01.2022 TOWNSVILLE CLAIM TIP: Contamination A flood event such as this one does more than merely fill properties with water. All too often, the entire sewage system als...o overflows, contaminating the water that flowed through your homes last week. Dead animals and a wide range of other contaminants would have been collected by the passing waters, and all of this works together to cause serious health hazards to homes and businesses affected. Bacteria and other nasties can soak through wall linings, skirting boards and floors. Particularly in a situation in which flood-waters sit in a property for hours or days before receding, you can be confident that all of the nooks and crannies of your property will be potentially contaminated. Any good restoration or remediation company will tell you that floodwaters in an event like this are considered Category 3 Water, or Black Water. Sewage Cleaning Australia notes that Black water poses a very significant threat to human health as it can carry a wide variety of pathogens and allergens. The severity of the health threat depends on the degree and extent of penetration into the building environment. In essence, everything that has been inundated with black water will need to be replaced, unless your insurer can provide you with a guarantee (and I would request full swab tests and laboratory test results from a qualified microbiologist) that an item has been fully inspected and tested and is clear of any bacteria or contaminants. Areas that may become battle grounds with your insurer include: 1. Floor tiles many assessors or builders will try to argue that floor tiles are water-tight and don’t need to be removed. What they won’t tell you, though, is that the grout between the floor tiles is NOT water-tight, and contaminants can get underneath the tiles through the often-porous grout. An insurance company would have to test the flooring underneath each tile to be able to confirm no contamination, which clearly is not feasible without replacing the floor tiles. DO NOT allow yourself to be bullied on this point. Expect, and demand, that floor tiles will be removed and replaced to allow full de-contamination of your property. In all likelihood, the flooring itself may also require replacement if any water has seeped into the floor (which is usually some type of composite-board such as yellow-tongue). 2. Some assessors or builders will try to tell you that they only need to strip out wall linings 20cm or 30cm above the water line. This is NOT correct, and all product documentation for the various gyprock or plasterboard type linings will note that whole sheets need to be replaced. There is usually a join at 1.2m or 1.35m above the floor height (if the wall sheets are fixed horizontally), and the wall can be stripped out to the join at that height, but NOT any lower. Again, do not be bullied into accepting a reduced scope of works simply to save the insurer money. If the water line in your home was higher than the 1.2m join, the entire wall lining will need to be stripped out and replaced. In this instance, the cornice also needs to be replaced, and therefore the ceiling will need to be repainted. 3. Some assessors or builders will try to tell you that they won’t need to strip out wet areas such as bathrooms or laundries. Again, this is mostly NOT correct. They have to be able to access EVERY wall cavity, so unless all four wall cavities around a wet area can be accessed from the other side, they will need to strip out that wet area too. Mostly, bathrooms adjoin the external wall of a house, so the only way to access all 4 wall cavities would be to actually remove the external brick-work or cladding. I have too often seen an insurer only access 2 or 3 wall cavities in a bathroom and just assume the other cavity is fine. This is because a full strip out will cost them a significant amount of money due to waterproofing requirements and possible upgrades. 4. If the water level was only 5cm or so, and they want to try to just replace kickboards in kitchens and bathrooms etc (rather than all of the cabinetry), request and demand that your insurer engage a microbiologist to test the cabinetry to ensure no contaminants. Further, in the cleaning process, often water will damage those cabinets, and if there has been any splashing of contaminated product, there is a strong chance that the cabinets will be affected. Remember, it is up to your insurer to PROVE that anything they don’t want to replace is actually clear of contaminants, not just to assume, and to try to convince you that it’ll be fine don’t worry about it. 5. Your insurer may try to clean your contents items rather than replacing them. Many contents items cannot be fully cleaned and restored, and again, it is up to your insurer to be able to prove that items are not contaminated. Proper testing will often cost $50 or more per item, so they may try to sample test 1 item in 10 or something similar. Again, do not accept this, because these are your goods and you need to be absolutely certain that your goods are not contaminated. When I get involved in arguments with insurance people over these sorts of issues, I challenge them with the question, Would you be happy to leave this item in YOUR house? It may seem in this post that I am encouraging you to be difficult with your insurance company in the coming days. Nothing could be further from the truth. If your insurer genuinely acts in your interest, they will do the above things without you having to challenge them at all. If, on the other hand, you see corners being cut such as those I have noted above, that is a red flag that your insurer (or their assessors/builders) are trying to minimise the damage, at your expense. You pay HUGE insurance premiums in Nth Queensland, and you have a right to expect that you will be fully indemnified in an event such as this, without having to accept ongoing contamination or other issues. Believe me, some of our Whitsundays clients ended up with houses being totally stripped back to framework, when issues of contamination and mould were not properly addressed in the months immediately following Cyclone Debbie. Following the above steps will reduce the chance that you will have to endure the 2-year nightmare some of your friends in the Whitsundays have endured. 12.01.2022 *** A Message from the Townsville City Council *** *** Massive Joint Clean Up Effort *** Massive joint effort for targeted cleaning of streets, houses and bulk waste removal... The Townsville City Council, Queensland Fire and Emergency Services and the Australian Defence Force will commence a three stage clean up from Thursday 7 February to Tuesday 12 February in the worst impacted suburbs including Railway Estate, Hermit Park, Oonoonba, Idalia, Rosslea, Annandale, Mundingburra and West End. Stage 1 sees the Townville City Council and Australian Defence Force starting road cleaning and debris pick up on Thursday 7 February and Friday 8 February. Stage 2 sees Queensland Fire and Emergency Service and Team Rubicon move in from Friday 8 February to Sunday 10 February to clean houses and yards and move hard rubbish to the curb for collection. Stage 3 will see the Townsville City Council and Australian Defence Force begin the collection of hard waste from Monday 11 February. Townsville Water and Waste Committee Chair Russ Cook said the community understandably wants to begin cleaning up, but it must be done safely, urging residents not to place spoiled or damaged items on the footpath until Council advises it is safe to do so. The city remains in a disaster response and is still at risk of flood events in the next few days. We are still seeing water moving in flood-affected suburbs due to storm rain or tidal activity so we don’t want old furniture, mattresses and garden waste being placed on the kerbside interfering with the important recovery work of Ergon and SES. I encourage residents to take advantage of the free access to waste facilities at Stuart, Hervey Range and Magnetic Island, which are open for residents to dispose of flood waste items. Ergon Energy has specifically requested residents do not place waste items near electrical pillar boxes and power poles. Food waste dumps are open at Bunnings Domain Central and North Shore for residents to dispose of food waste. An additional food waste disposal site will be open in the carpark at the Murray Sporting Complex soccer field carparks on Murray Lyons Crescent, Annandale from 9am tomorrow. Council’s normal rubbish collections have resumed for households on streets not impacted by flooding.

06.01.2022 Further support provided to monsoon-affected ratepayers Townsville City Council is providing further support to ratepayers directly impacted by the unprecedented monsoon. Three-month rates extensions will be offered to ratepayers who were directly impacted by the monsoon for the next two six-monthly rates notices.... Townsville Mayor Jenny Hill said the three-month rates extensions would help ease the financial burden of recovering from the city’s worst natural disaster. Council understands that many households and small businesses may have a number of unexpected bills from clean up and repair works, Cr Hill said. These extensions will allow property owners who had their property damaged during the monsoon more time to pay their rates bill. Proving support to help our community recovery from this natural disaster is Council’s top priority. Recovery will be a whole of community effort, but Townsville residents have an amazing spirit of resilience and mateship that will help to get us through this. Townsville Local Recovery and Resilience Group Chair Deputy Mayor Les Walker said many families and businesses were still facing a long road to return to normal. The rate of recovery will vary between households and businesses and Council understands that this process may take a significant amount of time for some, Cr Walker said. The rates extensions will provide property owners and small businesses extra capacity to plan and budget while they are getting back on their feet. The Townsville Local Recovery and Resilience Group is also taking a role in trying to ensure the insurance industry plays a responsible role in rebuilding our city.

01.01.2022 Last night the Qld Labor Government gave their Minister's unfettered power to change many conditions in Act's of Parliament by Regulation, with no real scrutiny of the Parliament. There were no changes the LNP could vote on or amend to Commercial or Residential Tenancy Laws. This Regulation can be altered at any time by the Minister without any real oversight but expires in December.
