In terms of criminal and traffic law what this means is that persons who are not present in a court room will not be at risk of going to jail.... Bail applications will be able to be run on account of delays being encountered and persons are more likely to get bail granted. 22.01.2022 DANGERS OF USING MOBILE PHONES WHILE DRIVING Thousands of Australian drivers are still being caught using mobile phones while driving. The new cameras in Sydney are catching almost 1000 people a day.... Some have even been caught using 2 phones and not holding the wheel at all. We are now all aware of the dangers of using phones which distract our attention from the road. With the new cameras, more people will be detected and fined. In NSW, where the new technology is being trialed, fines will be implemented 1 month after the 3 month trial is concluded. However the risk is much greater as a collision can result in serious injury or death. You may also be charged with more serious offences which can result in prison sentences. 21.01.2022 CRASHED NAKED A 19yo seemingly with drug / serious mental health issues has been driving naked around town and crashed. This incident highlights the importance of addressing mental health issues in conjunction with dealing with legal issues particularly for young offenders.... 21.01.2022 FATAL CRASH - NO JAIL TIME Dangerous Driving Causing Death would normally always result in a jail term. From our perspective we do not see that the driving was in fact dangerous, although we acknowledge that we do not know the full facts. In context of the sentence outcome perhaps this is what the sentencing Judge also factored in.... Dangerous driving usually involves extreme high speed and erratic acts on the road, mere inattention does not normally fit the definition of dangerous driving. 20.01.2022 BEER TRUCKS STRANDED EN ROUTE TO DARWIN Darwinites are facing the crisis of a lifetime - a beer shortage. A truck full of frothies has been delayed in Longreach, in Central West Queensland, where they will likely be stuck for a week or more.... The NT News reported that about 25 trucks are delayed in the Queensland town due to flooding. But there is good news. A spokesman for Carlton & United Breweries confirmed their beers were still able to travel up the Northern Territory capital, so Darwinites wont have to wait out for much longer. 17.01.2022 DAD FINED FOR RIDING SCOOTER Highway Patrol Cops pull over a Dad and his son riding an electric scooter on Bondis famous promenade fining him $2,020 and suspending his licence. Mr Kozmin wasnt far along the popular promenade when he was pulled over by the highway patrol car. ... Officers fined Mr Kozmin $2020, claiming he had been riding an unregistered and uninsured vehicle, was riding on the footpath and had failed to wear a helmet. Police said their checks showed Mr Kozmin already had a suspended riders licence but he told officers he was unaware of the suspension. The patrolmen then handed him a notice making it clear his licence was suspended. The crackdown follows the deaths of five people involved in heavy-vehicle crashes last month in New South Wales.... To ensure vehicles leaving and entering New South Wales are safe, authorities are coordinating efforts with Queensland, Victoria, South Australia and the ACT. 12.01.2022 APPEALING AN INFRINGEMENT NOTICE (LICENCE SUSPENSION) IN COURT You have committed a traffic offence and the Department of Transport and Main Roads have sent you an infringement notice (fine). You dont dispute you have committed the offence, though you have you reasons for why you should be given some leniency. What do you do? ... It is possible to appeal the suspension, which is to say to get it removed completely, or at the very least, reduced. You do this by "court electing" the infringement notice. This means you can have your day in Court and plead why you should be given leniency. The Court will look at your individual circumstances, including: - - Your driving record; - Why you need your licence; - Your character (character references are helpful); - What hardships you or other people will face if you dont have a licence. I understand that people come to court to make a point, but perhaps this is not the best way to do it through your choice of t-shirt.... 07.01.2022 LANE FILTERING ON ROADS The New South Wales Governments Towards Zero road safety campaign uploaded a video to its Facebook page last week about lane splitting. This is where motorcyclists scoot between slow moving or stationary cars. What is lane filtering?... Lane filtering is when a motorcycle rider moves alongside vehicles that have either stopped or are moving slowly (less than 30 km/h). Motorcycle lane filtering laws apply in NSW, with strict conditions. Motorcyclists must only lane filter when travelling less than 30 km/h. Motorcyclists can lane filter through stationary and slow moving traffic. Motorcyclists caught moving between traffic at over 30km/h face heavy fines and three demerit points under the offence called lane splitting It is illegal for motorcyclists to lane filter: next to the kerb next to parked vehicles in school zones Motorcyclists should not lane filter around heavy vehicles and buses. Only fully licensed motorcyclists are allowed to lane filter. 04.01.2022 SHORT SHORTS OFFEND In days gone by the expectation was that if you had been accused of a crime read in traffic offence you ought to turn up to court wearing a suit. Today people turn up in very different and more casual attire, sometimes even wearing thongs....
